Long, <br />Division Director <br />DATE: May 6, 1992 <br />T0: Bruce Humphries <br />FROM: Larry Oehler ~jB <br />RE: USF&WS Protocol-Bird Kills-BMG <br />You suggested that I contact USF&WS regarding protocol BMG must follow when <br />bird kills are discovered at their tailings ponds or collection pond <br />I contacted Gary Mowad, USF&WS Enforcement Officer in Golden, phone x'31-5270. <br />He says the protocol is: <br />1. BMG notifies Mr. Mowad immediately by phone of bird kills <br />2. Mr. Mowad decides seriousness - can use his own discretion - <br />a. Can have BMG chill or freeze birds and send to own 'ab for <br />analysis Cno special report form). <br />b. Can have DOW investigate and start chain of command-submit <br />birds directly to lab. <br />c. Can conduct his own investigation, pick up birds anc: have <br />analysis done. <br />He is having BMG send birds to a lab of their choice for <br />now, but if bird kills continue, he or DOW will pick. birds up <br />and have analyzed. <br />3. A copy of the lab report is sent to Mr. Mowad. He decides whether <br />further analysis is warranted. Mr. Mowad does not consider the <br />problem of bird kills at the San Luis Project serious enough yet to <br />notify 8MG of violation of Federal laws. Mr. Mowad was told that <br />CN concentrations would be below levels toxic to wildlife within <br />one week of the start of treatment with cytox. He will notify BMG <br />of violations of the Migratory Bird Act if kills continue or the <br />cyanide concentrations are not reduced below levels toxic to <br />wildlife. <br />
