We scheduled a meeting <br />with the representative of Lincoln DeVore, Larry Frank, for <br />March 29th on the site. However, it snowed that day, and we <br />had to postpone it to March 31. Even on that date the area <br />was so muddy that we could not get off of the road with a <br />pick-up truck. You may recall that we had to postpone at <br />least one inspection because of snow in that area. <br />Our attorney previously wrote to you on this matter on <br />March 21, 1994. Mr. Boies met with me again and determined <br />that he felt uncomfortable making the analysis required, so <br />At the time we met, Mr. Frank observed the existing <br />highwalls, and his initial reaction is that they appear to be <br />stable and that the naturally occurring slopes around the <br />corner from this site, which are in the neighborhood of 80 to <br />100 feet high, appear to be stable. However, he wants to do <br />additional testing, which requires core drilling. I am <br />transmitting with this letter a copy of his letter, dated <br />April 8, indicating what the intends to do. Unfortunately, <br />this requires a drill rig and there have been four snows <br />since March 31 in this area.
