<br />9. Page 2.04-34, last paragraph indicates that Kaiser Resources may graze the reclaimed <br />area the final two years of the liability period. Rule 4.15.7(3)(£) allows for grazing as <br />long as the reference area and the reclaimed area receive the same treatment and <br />management during the final two years of the liability period. If the reclaimed area is <br />grazed will the reference area be grazed at the same time? The season of grazing and <br />animal stocking rates should be similar as well. Pleaser clarify this plan for grazing <br />of the reclaimed area. <br />10. Exhibit 5, page 3, describes techniques that will be employed to determine <br />revegetation success. The permit states that, "cover will be estimated along each <br />transect at one foot intervals;' and will use an "ocular sighting device". Please <br />elaborate on this "ocular sighting device". Does this device assure the objectivity of <br />the data? Methods the Division tends to see used are an ocular device mounted on a <br />frame. A free standing frame helps reduce the chances of inadvertent subjectivity <br />being introduced into the data. <br />11. Rule 2.04.18. Please insert the Ground and Surface Water Monitoring Schedule. <br />12. Page 2.05-2 paragraph 4 states that a stake will be driven into each pond to determine <br />the sediment level. Please insure that this is done prior to the end of this calendar <br />year if not already done so. <br />13. Rule 2.05.4 The following items need to be corrected. Table 11 & 12 do not have a <br />page number Table 13's page number is incorrect. Figure 5 should be deleted. <br />14. Numerous brochures, correspondence and obsolete designs exist in the appendices. <br />Please determine what material should be retained or consolidated, then delete the <br />outdated or unnecessary material. <br />Section V -Bonding Summary <br />The Division currently holds $320,000.00 in Letter of Credit for the reclamation performance <br />bond at the Chimney Rock Mine listing Kaiser Steel Resources, Inc as Principal. This <br />information must be undated and a new performance bond submitted with Kaiser Ventures <br />Inc. as the Principal.
