<br /> <br />Section III -Status of Stipulations <br />All stipulations from the original permit were resolved prior to the issuance of the permit <br />renewal in 1993. <br />Section IV -Decision to Require Revisions <br />As a result of this midterm review, the Division will require revision(s) of the permit to <br />address the following concerns with the currently approved Chimney Rock Mine permit <br />application. <br />1. DMG Application Form, pages 3 and 4. Please update the acreage amount to reflect <br />current conditions showing the total permitted acreage, affected acreage, and <br />disturbed acreage. <br />2. Rule 2.03.4. Please update all sections to reflect the existence of the "New" permittee <br />Kaiser Ventures Inc., and include any changes to the names or dates any of officer <br />assumed their respective position as well as any individuals who have left their <br />position. <br />3. Rule 2.03.4(3)(d). Please update this section if Kaiser Ventures have acquired any <br />other coal mining or reclamation operations in the United States. If so, also complete <br />Rule 2.03.4(3)(e). <br />4. Rule 2.03.5. Please update the compliance information to include any NOV's issued <br />since April 15, 1993 for this mine and any other surface coal mining and reclamation <br />activity owned or controlled by Kaiser Ventures Inc. <br />5. Rule 2.03.8. Please update this section to reflect that the original permit was issued <br />on January 7, 1983 and that the current permit was approved on April 20, 1993. <br />6. Rule 2.03.12. Please update Table 1 concerning the DMG permit and the <br />Department of Health's NPDES permit. <br />7. Rule 2.04.5. Since surface and ground water monitoring are still being conducted, <br />please include in the permit the baseline information for each station currently being <br />monitored. Baseline data should characterize the seasonal variations at each station <br />and should be included in the permit as an exhibit or an appendix. <br />The operator is still required to have information for an Alternative Water Supply. In <br />the event that surface water resources are impacted prior to bond release, this <br />information would be of importance. <br />8. Page 2.04.18, paragraph 4 states that trace metals in the surface water improve <br />downstream.
