December 1, 2005 <br />(coal operators) <br />Deaz (operator name): <br />As you may be awaze, the Colorado Mined Land Reclamation Boazd (Boazd) promulgated <br />revised Rules and Regulations of the Colorado Mined Land Reclamation Board for Coal Mining <br />(Rules) on September 14, 2005. The disciplines of the revised Rules were primarily <br />revegetation, reclamation success standards, weed management, land management during the <br />liability period, land use, wildlife, topsoil stabilization, prime farmland, and alluvial valley <br />floors. A detailed copy of the revised rules can be viewed on the Division's web site <br />(http://www.minim.state.co.us/Rules%20and%20Re sg htm). The revised rules became effective <br />on November 30, 2005. <br />Some of the revised rules will affect existing permit holders. Following is a list of the revised <br />rules, which will require action on your part, as well as the timeframe for such action. This list <br />does not discuss all of the revised rules, only those that may require revisions to permits or will <br />affect bond release procedures. Operators are encouraged to review all of the newly revised <br />rules. <br />Revised Rule 2.04.13(1)(e) requires documentation (seed tags, invoices, or other <br />compazable documents) in the annual reclamation report of seed mixes used for <br />reclamation. This rule pertains to all annual reclamation reports submitted after <br />November 30, 2005. <br />2. New Rule 3.03.2(1)(e) requires that all bond release applications include a notarized <br />statement that all reclamation work has been completed in compliance the approved <br />permit and the Rules. This rule is in effect for all bond release applications received after <br />November 30, 2005. <br />3. New Rule 4.15.1(5) requires that each operator submit a weed management plan that will <br />become part of the permit requirements. If this is not already in the permit a minor <br />revision for a weed control plan in accordance with Rule 4.15.1(5) will need to be <br />submitted by March 1, 2006. <br />
