Long <br />Dwisipn Director <br />RE: Reduction of permit area; Red Canyon Mine; File No. C-81-034 <br />Dear Mr. Stover; <br />During my complete inspection at the Red Canyon Mine during June, <br />you requested the Division's opinion concerning reducing the permit <br />area to include only the surface disturbance. This would mean that <br />the undermined area would be released from the permit area. The <br />Division has a Policy Memorandum, dated April 13, 1987, which <br />addresses this issue. This memorandum has been enclosed for your <br />information. <br />Because this area has not been revegetated, due to damage from <br />subsidence, it would not have to go through the minimum 10 year <br />liability period for revegetated areas. Release of reclamation <br />liability for underground workings can be done only after all <br />mining in the area is completed and the major subsidence effects, <br />if any, have been manifested. The minimum liability period shall <br />be a minimum of three years after mining is completed. <br />The request for release of reclamation liability will be processed <br />in accordance with Rule 3.03, Release of Performance Bonds. The <br />Division must make written findings in regard to whether this area <br />shall be released from liability. <br />Before this release process, the Division must make written <br />findings concerning ground water. Since the majority of Red <br />Canyon's ground water monitoring wells are located within this <br />undermined area, and not the surface disturbance area, these wells <br />would need to be abandoned and reclaimed. However, before this can <br />be accomplished the Division must make a finding that there have <br />been no negative impacts to ground water from mining activity at <br />the Red Canyon Mine. The removal of the wells should be submitted <br />to the Division in the form of a technical revision. I would <br />recommend that the application include a final sampling of all <br />monitoring wellsjpiezometers. <br />I would recommend that your release application contain the <br />following, but not limited to: a final subsidence survey of the <br />
