Proposed Decision <br /> The Colorado Division of Minerals and Geology proposes to approve with stipulations an application for a <br /> permit revision (PR-02). The revision application was submitted to the Division on May 3, 1996, and deemed <br /> administratively complete on May 13, 1996. The revision was submitted, in part, to address deficiencies and <br /> inconsistencies identified in the Division's August 18, 1995 mid-term permit review, and in part to organize <br /> the permit application package into a more useable format. The previous permit application package was <br /> completely replaced by a new six volume permit application submitted as PR-02. The format of the documents <br /> was completely reorganized,and significant and substantive changes were incorporated in various sections of <br /> the application. The revised application does not propose expansion of disturbed, affected, or permitted <br /> acreage, beyond that previously set forth in the approved permit. <br /> The application was submitted by Powderhom Coal Company for the Roadside North and South Portal Mines <br /> (formerly Roadside and Cameo Mines). This decision is based on a finding that the operation will comply with <br /> all requirements of the Colorado State Program as found in the Colorado Surface Coal Mining Reclamation <br /> Act,C.R.S. 34-33-101 et seq.,and the Regulations promulgated pursuant to the Act. If no request for a formal <br /> hearing is made within thirty(30)days of the first publication of the issuance of this proposed decision, then <br /> this decision becomes final. The permit application, all supporting documentation and any stipulations or <br /> conditions will become a binding part of the permit. <br /> As a part of the application,the operator proposes continued use of a segment of public road in Coal Canyon <br /> for haulage of coal processing waste to designated disposal areas(Haul Road 4). The operator has previously <br /> modified sections of the road and proposes further changes to widen the road for refuse haulage in the future. <br /> Existing and proposed coal mine waste disposal sites and associated facilities are within 100 feet of the <br /> existing road. The Bureau of Land Management(BLM) has reviewed and approved the operator's plan for <br /> use,modification,and retention of the road,and the plans to locate certain facilities within 100 feet of the road. <br /> Pursuant to Rule 2.07.6(2)(d)(iv), the public is hereby notified of an opportunity for public hearing, if <br /> requested, regarding the operator's use of the road and location of affected areas within 100 feet of the road. <br /> The purpose of such hearing would be to determine whether the interests of the public and affected landowners <br /> would be protected. <br /> The following stipulations ate proposed for the revised permit. Stipulation Nos. 2,7,and.15 were incorporated <br /> through previous permitting actions, and are retained here. Stipulations 16 through 22 are being added with <br /> PR-02. <br /> STIPULATION NO. 2 <br /> THE PERMITTEE SHALL SUBMIT TO THE DIVISION AN ANNUAL REPORT OF INFLOWS, <br /> DISCHARGES AND CONSUMPTION OF WATER WITHIN THE MINE. THIS REPORT IS TO <br /> INCLUDE A MINE WORKINGS MAP SHOWING THE LOCATION AND QUANTITY OF <br /> INFLOWS; A TABLE KEYED TO THE MINED MAP WHICH SHALL CONTAIN THE SOURCE <br /> (I.E., FAULTS, FRACTURES, ETC.), QUANTITY, DURATION, AND QUALITY (pH, <br /> ELECTRICAL CONDUCTIVITY, AND TEMPERATURE) OF ALL INFLOWS; A TABLE <br /> CONTAINING RECORDS OF WATER DISCHARGED FROM THE MINE, CONSUMED IN THE <br /> MINE AND IMPORTED FOR USE WITHIN THE MINE; AND A DISCUSSION OF THE WATER <br /> BALANCE IN THE MINE. <br /> 2 <br />
