<br />Mr. Ralph J. Ponce -2- February 2, 1994 <br />Atchison, Topeka and Santa Fe <br />Railway Company <br />2. Following excavation of the coal, the Division proposes to regrade the loadout area to direct <br />drainage away from the railroad tracks. Drainage shall be accomplished by grading the entire <br />surface area to form a shallow trough that will direct runoff eastward. <br />3. The Division proposes to establish vegetation within the trough to reduce erosion and <br />improve the quality of the runoff water. The area to be revegetated will be located at least <br />100 feet away from the existing rail line. <br />Thank you for your cooperation. If the Division does not receive a response to this letter by <br />February 16, 1994, the Division will assume your consent and will proceed with the plans <br />described herein.
