-33- <br />~ ~• <br />With the imposition of the stipulations contained within the "Probable <br />Hydrologic Consequences of Mining" and "Backfilling and Grading" sections of <br />these findings, the Division finds that Pueblo Coal, Inc. is in compliance <br />with the requirements of Rules 2.05.3(8), 2.05.4(2)(f), 4.10 and 4.11. <br />XIII. <br />In Section 2.05.4(2)(8) of the amended permit application, the applicant has <br />stated that there will be no mine openings that require sealing, and that all <br />exploration holes will be plugged in accordance with Rule 4.07. <br />The proposed operation is in compliance with the requirements of this section. <br />XIX. Bonding - Rule 2.05.4(2)(b) <br />The applicant, in Section 2.05.4(2)(b> and Table 5-6 of the application, has <br />proposed a bond of $1,643,339.00. The Division has reviewed the information <br />provided by the applicant, assuming a maximum disturbance of 115 acres, and <br />believes that this amount would be adequate to reclaim the operation. <br />With the posting of this bond amount, the proposed operation is in compliance <br />with the requirements of this section. <br />XX. Subsidence - Rules 2.05.6(6) and 4.20 <br />No underground coal extraction is proposed within the mining and reclamation <br />plans submitted by Pueblo Coal, Inc. for the Carbon Junction Mine. Therefore, <br />the requirements of those rules of the permanent regulatory program which deal <br />with ground surface subsidence do not apply in this instance. <br />XXI. Special Categories of Mining other than AVF and Prime Farmland - <br />There are no proposed applicable special categories of mining at the Carbon <br />Junction Mine. <br />The permit application is in compliance with the requirements of this section. <br />XXII. Miscellaneous Compliance - Rules 2.05.6(5), 4.02, 4.12, 4.19, <br />4.21, 4.28 and 4.30 <br />No problems were identified with respect to the requirements of these sections. <br />The proposed operation is in compliance. <br />XXIII. Operations on Land Sub.iect to Limitations or Prohibitions - Rules <br />2.03.7 and 2.10 <br />The proposed operation is in compliance with the requirements of these <br />sections and 2.07.6(2)(d> for the following reasons: <br />
