i • <br />wildlife species. It was determined that pastureland and <br />rangeland meet the requirements of Rule 4.16 for the permit <br />area (2.07.6(2)(1)). <br />14. Specific approvals have been granted or are proposed. These <br />approvals are addressed in the following section, Section B <br />(2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the <br />applicant would not affect the continued existence of <br />endangered or threatened species or result in the destruction <br />or adverse modification of their critical habitats <br />(2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, <br />Reclamation Fees Branch. As of this time, Colorado Yampa <br />Coal Company, the operator is current in the payment of <br />reclamation fees required by 30 CFR Chapter VII, subchapter R <br />(2.07.6(2)(0)). <br />SECTION B <br />The following findings and specific approvals are required by <br />Rule 4: <br />Roads - Rule 4.03 <br />Approximately 11 miles of haul and access roads existed <br />within the permit area. The major portion of the haul road <br />system consisted of 55 foot wide haul roads constructed near <br />final grade on the post-mined topography. Two large fill <br />embankments were constructed, with the largest exceeding 80 <br />feet in height. The approved reclamation plan proposed <br />removal of the roads, with grading as required to achieve <br />approximate original contour. Material from the large fills <br />would be hauled to one of the approved excess spoil disposal <br />areas. TR-12 approved the retention of portions of haul <br />roads and access roads to remain as permanent to facilitate <br />the post-mine ranch operation. These permanent roads are no <br />wider than 20 feet and any large fill areas were removed, <br />drainage modified where needed and roads aligned to more <br />closely track along the contour. <br />1. The Division proposes to approve the retention of the <br />roads depicted on Map Nos.36A and 36B since it is <br />compatible with the approved post-mining land use, and a <br />request for its retention was submitted by the landowner <br />(4.03.1 (1) (f) (i)) . <br />18 <br />
