SUMMARY OF CHANGES REQUESTED <br />Pursuant to Rule 2.08.3, the Division has conducted a midterm <br />review and has found that certain minor modifications are needed to <br />ensure future compliance with the Colorado Surface Coal Mining <br />Reclamation Act and the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining. <br />2.03.5 Compliance Information <br />1. Please provide documentation of final resolution or current <br />status of State of Virginia and West Virginia violations <br />listed in permit stipulation No. 23. <br />2.05.3(9) Ponds, impoundments and diversions <br />A plan for small area exemption sediment controls to be <br />installed at the rail loop area following sediment pond <br />removal has previously been submitted. This was required due <br />to the fact that the existing sediment pond will necessarily <br />be eliminated during reclamation grading. Please evaluate the <br />reclamation plan, and provide alternate sediment controls <br />pursuant to Rule 4.05.2 (either relocated sediment ponds or <br />small area exemption sediment controls and demonstrations) for <br />remaining disturbance areas where reclamation grading will <br />impact existing sediment control facilities. Revised sediment <br />controls and/or demonstrations would appear to be warranted <br />for post-grading areas in the North Portal Coal Handling Area, <br />the 2-West Portals, South Fan and Borrow Area, and possibly <br />other areas. <br />2.05.4(2)(c) backfilling and grading, and 2.05.9(2)(g) mine sealing <br />3. There would appear to be potential for springs that emerge in <br />the immediate vicinity of the sealed South Mine Portals to <br />compromise the stability of the portal area backfill, unless <br />this drainage is accounted for in the reclamation design. <br />Please evaluate the potential impact of the springs on backfill <br />stability, and amend the plan as necessary to ensure compliance <br />with the requirements of 9.19.1(2) and 9.19.2(1). <br />
