Approval was received <br />from the County of r4ontrose, Colorado to move the road. The 1~lined Land <br />Reclamation Division also approved the temporary relocation on August 14, <br />1980 as part of permit numoer 75-36A. Subsequent to these approvals the <br />temporary roadway was constructed. Anew permanent roadway will be <br />constructed after mining activities in the road area have been <br />completed. A complete discussion of this procedure is contained in the <br />permit application in Tab 12 Volume IV, pages 1[-7, and Appendix 12-2. <br />XXVI Demonstration that Surface l.oal Plininq and Reclamation <br />The Uivision finds, pendiny the satisfactory resolution of the <br />stipulation contained in this document and based on information provided <br />in the permit application, that surface coal mininy and reclamation <br />operations can be feasibly accomplished under the proposed plan contained <br />in the application. <br />The proposed operation is in compliance. <br />XXVI1 Com atibilit~ with Antici ated Ad acent 0 erations - <br />Rule 2.07.6 2 il. <br />Peabody Coal Company's proposed Nucla mine is not inconsistent with <br />either existing or anticipated operations in adjacent areas. <br />The proposed operation is in compliance. <br />XXVIII kecla~nation Fees <br />.F <br />Based on communication with USf•1 personnel, Peabody Coal Company has paid <br />all recla~riatinn fees as required by 30 CFR, Chapter VII, Subchapter R. <br />Uoc.
