I <br />' ~ ~ -23- <br /> <br />There are approximately 1.1 miles of existing haul roads at the mine. <br />Future ruining will require that total to increase to 1.75 miles. The <br />mine site is gently sloping which .makes road construction, maintenance, <br />and reclamation much simpler. The roads were designed not only to serve <br />the operation and to accomnrlate the natural drainaye as well as the <br />sediment control system. <br />The operator has requested only one variance from the desiyn criteria of <br />Rule 4.03. Paye 7-1-23 of the application requested and justified a <br />variance from the culvert spacing requirements of Rule 4. U3.1(4)(e)(vi). <br />This Ilule requires culverts to be spaced at intervals dependent upon road <br />slope. Employing this spacing requirement at this mine would result in <br />water being concentrated on slopes not equiped to convey water. Instead <br />the operator will route water by collection ditching and discharge the <br />water into ~najorā¢drainage channels. For these reasons the Division is <br />granting Peabody Coal Company a variance from Rule 4.U3.1(4)(e)(vi). <br />Une public road has been relocated by the operation. County Road 1"24 <br />(N-A) was temporarily relocated away from the active mine area in 1978. <br />This was conducted by ayreement with the County of iā¢tontrose in January <br />1978. This agreement has since been amended to allow an additional <br />relocation as mining proyresses north. The Division finds that such <br />relocation will protect tFre interests of the puulic and affected <br />landowners (Rule 2.U7.6(2)(d)(iv)). This finding is based on the <br />following facts: <br />A. The road was previously relocated by the operator (1978) <br />without incident; <br />8. The operator obtained the necessary approvals from <br />Montrose County (see documents in Uol. IV, Appendix 12-2 <br />of the application); <br />C. Wlien the public was afforded the opportunity to comment <br />on the proposal no co~n~nents were received oy ttre Division; and <br />D. The road relocation and restoration will be conducted <br />with designs approved by the County and in accordance with <br />Section 203.06 of the Colorado Division of Highways <br />Specifications. <br />XV111. Ponds, Impoundments and Diversions - Rules 2.053(4) and 4.05 <br />To control runoff from the mine area the operator has designed and <br />constructed a drainaye and sediment r_nntrol system. A discussion of this <br />system can be found in Volume 11, Appendix 7, and payes 7-34 to 7-38, and <br />Volwne IV, page 1L-y. . <br />
