a) Colorado Division of Minerals and Geology, permit No. M-1993-030, This permit is a Limited <br />Impact Mining Permit covering the Properties. Total disturbance under this permit is 2.00 acres <br />with 1.40 acres currently disturbed. <br />b) US Forest Service Plan of Operations. The Properties are included in a 3;vear operating~lan <br />beginning July of 2002. The plan is filed with the USFS District Ranger for the South Park <br />District in Fairplay, Colorado. <br />c) Colorado Department of Health, Storm Water Drainage Permit. The Properties are currently <br />certified under permit number COG-500808 issued on Apri127, 1993. <br />d) Teller County Board of Commissioners, Conditional Use Permit. The Properties are included <br />under a Conditional Use Permit issued to John O. Buckner on April 22, 1993 by the Teller County <br />Board of Commissioners which is regulated and enforced by the Teller County Planning Director <br />whose offices are located in Woodland Park, Colorado. <br />The POSP agrees to be responsible for all existing conditions, water discharge, mine dumps, and <br />other like conditions that exist on the Property on the effective date and henceforth. If the same be <br />altered by the FOSP, the POSP shall become and remain liable for the same then and thereafter, <br />and the POSP's responsibility shall extend until rectified. The POFP agrees to be responsible for <br />any new work done separate of the POSP and will be responsible for any alterations he causes. <br />The permits outlined in A, B, C, and D above will be amended and updated as necessary by the <br />POSP to continue operations on the Properties. The POSP will reestablish same permits, as they <br />pertain, in his own name if required by the permitting agencies. The POSP will be responsible for <br />all permit-related activities on the Properties henceforth unless this Agreement is terminated. <br />The POSF accepts all liability for disturbances, physical and/or legal created by the POSP on the <br />property and agrees to pay all bonds and cleanup casts associated with the POSP's actions, but <br />limited to the POSP°s actions, on the Properties. <br />In the event this Agreement is terminated, the POSP will have a period of four ("4) accessible <br />months in which to complete reclamation work. Accessible months are generally April through <br />October annually due to the nature of climate and snowfall. The POSP will not Leave, abandon or <br />desert any unsatisfactory or uncompleted situations/conditians created by the POSP. The POSP <br />will acquire approvals in writing from any/all governmental agencies that all reclamation work, <br />clean-up to any area impacted by this operation have been accepted, approved, signed and dated <br />by the agents, inspectors appointed and authorized to issue a final approval and acceptance of/for <br />the required reclamation, reseeding, restoration and any additional obligation to restore the sites <br />impacted during mining operations brought about by this Agreement. <br />During operations, the POSP assumes all responsibility and liability for safety and fire suppression <br />or conditions. The POSP is responsible for all trash, garbage, human wastes, clean-up and <br />disposal to the satisfaction of the governmental authorities. <br />The separate liability of the POFP and/or the POSP shall survive any release of a permit or bond <br />by any governmental agency, as well as the termination of this Agreement. <br /> <br />
