<br />prime farmland mapping unite are found within the permit area or within <br />Routt county. The local office of the SCS confirmed this finding in a <br />letter dated September 24, 1984. This letter can be found in &xhibit 24 <br />(2.07.6(2)(k)). <br />12. Based on information provided in the application the Division has <br />detexaiined that alluvial valley floors exist within the permit or <br />adjacent area. The alluvial valley floors are known as the Fish Creek <br />AVF, Foidel Creek AVF, Foidel/Middle Creek AVF, and the Trout Creek AVF. <br />Based on information provided by the operator the Division finds that for <br />all of the above AVF's; <br />a) the proposed mining operation will not interrupt, discontinue, or <br />preclude farming on the alluvial valley floor <br />b) the proposed mining operation will not cause material damage to <br />the quantity and quality of surface and groundwater that supply <br />the alluvial valley floor <br />c) the proposed operation will preserve the essential hydrologic <br />functions of the alluvial valley floor <br />2.07.6(2) and 2.06.5(3)(C)). <br />For additional specific findings concerning this alluvial valley floor <br />please see Section B, XVII. <br />13. The Division hereby approves the post-mining land use of the operation. <br />It was determined that the post-mining land use of rangeland, pastureland <br />and cropland meet the requirements of Rule 4.16 for the permit area <br />(2.07.6(2)(1)). <br />14. The Division finds that specific approvals have been granted or are <br />proposed. These approvals are addressed in the following section, <br />Section B (2 .07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would <br />not affect the continued existence of endangered or threatened species or <br />result in the destruction or adverse modification of their critical <br />habitats (2.07.6 (2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees <br />Hranch. As of this time, Twentymile Coal Company is current in the <br />payment of reclamation fees required by 30 CFR Chapter VII, subchapter R <br />(2.07.6(2)(0)). <br />SBCTION H <br />The following findings and specific approvals are required by Rule 4: <br />I. Roads - Rule 4.03 <br />A. Haul Roads <br />Haul roads are discussed on pages 2.05-19 to 2.05-24 (a) of Vol. I <br />and pages 2.05-7 to 2.05-14 of Vol. VIII of the permit application. <br />1. The Division proposes to approve the location of a portion of <br />haulroad C in the channel of Foidel Creek, which drains a <br />watershed of at least 1 square mile, as depicted on Map No.24 <br />Surface Facilities and Freshwater Systems Haulroad C passes <br />over Foidel Creek in two places and the flow is diverted under <br />the haulroad by the use of culverts (4 .03.1(2)(b)). <br />13 <br />
