<br />Division. Stipulation No. 34 requires TCC to submit a copy of their agreement <br />with the owner of the mobile home to the Division. <br />The active Stipulations as of the 1993 PR-02 update are as follows: <br />STIPULATION NO. 11 <br />Prior to approval of any mining-related activities which would potentially <br />affect lands in the North 1/2 of Section 10, TSN, R86W or the Southwest 1/4 of <br />the Southwest 1/4 of Section 33, T6N, R86W (through future permit revision or <br />renewal) the permittee will submit acceptable right-of-entry information to <br />the Division. <br />STIPULATION NO, 27 <br />TCC must perform constant monitoring of all inflow or seepage encountered ae <br />the first, second and third left gateroads are advanced. TCC must report any <br />encountered measurable inflows to the Division immediately, and shall keep the <br />Division apprised of any changes of inflow. Monitoring of inflows shall <br />continue until the Division approves cessation. <br />STIPULATION NO. 28 <br />In the event that total accumulated inflow from the gateroad extensions were <br />to reach or exceed 50 gpm, TCC will cease further mining and seal the areas of <br />the inflow, until installation of the alluvial wells and stream gages is <br />completed and initial monitoring accomplished. In the event that installation <br />of seals becomes necessary, TCC shall inform the Division of its proposed <br />methodology in order to obtain approval before commencing installation. <br />Following installation, TCC must obtain approval to resume gateroad extension. <br />STIPULATION NO. 29 <br />TCC will submit proposed locations and descriptions of the alluvial wells and <br />stream gaging stations to be installed, and a schedule for their installation, <br />to the Division for approval within two weeks after approval of MR 91-69. <br />STIPULATION NO. 32 <br />Twentymile Coal Company will submit to the Division upon receipt from the <br />Colorado Department of Health the approval documents for their waste water <br />treatment system. <br />STIPULATION NO. 33 <br />Twentymile Coal Company will resolve all concerns of the BLM and Native <br />American Indians related to the rock art site SRT345 prior to longwall <br />undermining of the site. This will include considerations of the site ae a <br />Native American religious site. The mitigative measures may range from photo <br />documentation only to limited coal extraction to protect the site from <br />subsidence damage. All surveys and information will be submitted to the <br />^ivision as part of the confidential appendix, <br />STIPULATION NO. 34 <br />Twentymile Coal Company will complete archeological and cultural resource <br />surveys of all areas to be affected by surface disturbance or subsidence <br />within the new permit areas added by PR-02 (Southwest Mining District). This <br />information will be gathered and submitted to the Division 60 days prior to <br />mining in panels 7, B, or 9 of the Southwest Mining District. <br />
