<br />SLA6987, SLA6988, and SLA6983 will need to be surveyed and cleared by SHPO prior to <br />the beginning of the second permit term. <br />Five sites are associated with the haul road up Lorencito Canyon or the PI/P2 portal box cut <br />azea. These facilities will be constructed near the end of the first 5-year permit term. Sites <br />SLA6999, SLA6993, SLA6998, SLA6995, and SLA7000 have yet to be surveyed. <br />Therefore, the Division will attach the following stipulation to the permit; <br />STIP # 4 <br />LORENCITO COAL COMPANY SHALL CONDUCT CULTURAL RESOURCES <br />SURVEYS, SUBMIT THE SURVEYS TO THE DIVISION, AND RECENE SHPO <br />CLEARANCE PRIOR TO DISTURBAtNCE OR CONSTRUCTION ACTIVITIES <br />ASSOCIATED WITH THE P1/P2 HAUL ROAD, P1/P2 ACCESS ROAD, AND THE <br />P1/P2 BOX CUT, PORTAL, AND TEMPORARY OVERBURDEN STOCKPIl.E <br />AREA. <br />The final site, SLA7194, is located east of the Lorencito Canyon stream channel at the raw <br />coal loadout. There is no disturbance presently planned for this site and the site has been <br />granted SHPO clearance. <br />Ten additional sites were identified during 1997 data collection efforts for those sites <br />recorded as needing data in the 1996 preliminary survey. These sites were located in Jeff <br />Canyon, primarily in the area of a slight re-alignment of the P3 haul road. Sites 5LA7367, <br />SLA7368, SI.A7369, SLA7370, SLA7371, SLA7372, SLA7373, SLA7374, SLA7375 and <br />SLA7482 were all cleared by the SHPO as not eligible in a correspondence received by the <br />Division on July 17, 1997. <br />Numerous isolated finds were discovered at the Lorencito Canyon mine site. Isolated finds, <br />by definition, do not meet the criteria for eligibility and the SHPO does not normally provide <br />any clearance recommendation for isolated finds. No further work is required for all isolated <br />finds at the Lorencito Canyon mine. (2.07.6(2)(e)(n) <br />6. For this surface mining operation, private mineral estate has not been severed from private <br />surface estate, therefore, the documentation specified by Rule 2.03.6(2) is not required. <br />(2.07.6(2)(f)) <br />On the basis of evidence submitted by the applicant and received from other state and federal <br />agencies as a result of the Section 34-33-114(3) compliance review required by the Colorado <br />Surface Coal Mining Reclamation Act, the Division finds that Lorencito Coal Company, <br />LLC does not own or control any operations which are currently in violation of any law, rule, <br />or regulation of the United States, or any State law, rule, or regulation, or any provision of <br />the Surface Mining Control and Reclamation Act or the Colorado Surface Coal Mining <br />Reclamation Act.
