~~ <br /> <br />Some areas of fill construction for the surface mine have been surveyed for cultural and <br />historic resources. Fills I, 4, 6, 7, and 9 are included in the azeas of the 1996 or 1997 <br />surveys. However, Fills 2, 3, 5, and 8 were not included in the surveyed areas. Therefore <br />the following stipulation is required: <br />STIP # 2 <br />AS SHOWN ON MINE PLAN MAP 2.05.3-1, FOR THOSE AREAS OF FILLS 2, 3, 5, <br />AND 8 NOT ALREADY SURVEYED, LORENCITO COAL COMPANY SHALL <br />CONDUCT CULTURAL RESOURCES SURVEYS, SUBMIT THE SURVEYS TO <br />THE DNISION, AND RECENE SHPO CLEARANCE PRIOR TO DISTURBING <br />AREAS ASSOCIATED WTTH FILL DISTURBANCE. <br />25 sites were identified in the SHPO correspondence received March 20, 1997 in response to <br />the report based on the 1996 Metcalf preliminary survey. One of these sites, SLA6981, is <br />eligible for the National Register. This site is not within the 5-year mine plan but will need <br />to be addressed prior to the second permit term. The discussion that follows addresses each <br />of the 24 other sites. <br />Sites SLA7012, SLA7007, and SLA7003 are found within the disturbed area proposed under <br />the original plan for the coal loadout. These sites will not be disturbed since the proposed <br />location for the loadout has now been moved close to the mouth of Lorencito Canyon. <br />Ceeazance for these sites has not been granted but is no longer necessary due to the change in <br />plans. <br />Sites SLA7196, SLA7199, and SLA7202 on the P3 haul road up Jeff have SHPO clearance. <br />Site SLA6968 on the P3 haulroad on the west side of the ridge and site SLA7182 on the P3 <br />haul road immediately before Cow Canyon also have SHPO clearance. Two sites have <br />received SHPO instructions to be avoided. Site SLA7181 at the Cow Canyon/P3 haulroad <br />intersection and site SLA7208 on the way to the R1 portal will be required to be fenced out <br />so disturbance will be avoided during operations. Site SLA7186, also referred to as the Jeff <br />Place, is eligible for the National Register. Therefore, the following stipulation is attached to <br />the permit. <br />STIP # 3 <br />LORENCTTO COAL COMPANY WII.L NOT COMMENCE CONSTRUCTION <br />ACTNITIES AT THE RAW COAL LOADOUT OR DISTURB IN ANY WAY THE <br />AREA IDENTIFIED AS SLA7186 AS DEPICTED ON FIGURE 2 OF 3, CULTURAL <br />RESOURCE STIES AND SURVEY AREAS PRIOR TO THE COMPLETION OF THE <br />TREATMENT PLAN AND RECEIPT OF SHPO CLEARANCE. <br />In addition to SLA6981, seven other sites are within the life-of-rrtine plan for the surface <br />mine but not within the 5-year mine plan area.
