<br />The SHPO provided a response to each of these reports. On June 30, 1997, the SHPO provided <br />a written concurrence that site SLA7186 was eligible for the National Register under Criteria A <br />and D. They found the treatment plan satisfactory and indicated additional consultation would be <br />necessary if the operator was to disturb this azea prior to completion of the treatment plan. On <br />July 17, 1997, the Division received a written response from SHPO concerning the results of the <br />data recovery efforts for those sites needing data. Fifteen sites were granted clearance, two were <br />recommended for avoidance, and site SLA7186 is to be avoided until mitigation (treatment plan) <br />is completed. <br />On behalf of Lorencito Coal Company, Greystone Development Consultants submitted a request <br />fora 30 day extension for a decision on the application. This request was received June 30, <br />1997. <br />Another query of the Applicant Violator System (AVS) was conducted on the applicant, <br />Lorencito Coal Company, on July 1, 1997. Both the system and the OSMRE returned ISSUE <br />recommendations. <br />The applicant's responses to the Division's second round of adequacy issues was received by the <br />Division on July 2, 1997. <br />The SHPO provided additional correspondence on July 15, 1997 concerning various sites within <br />the surveyed areas of the mine permit area. Five sites from the 1996 survey were granted <br />clearance and ten sites from the 1997 report were also granted clearance. Two sites, SLA7208 <br />and SLA7181 were recommended for avoidance. Site SLA7186 was identified to be avoided by <br />all construction until the treatment plan has been completed. <br />Responses to the Division's letter of June 5, 1997 were received from Greystone Development <br />Consultants on July 17, 1997. These responses were focused primarily on concerns with regard <br />to wildlife issues. <br />The Division reviewed the latest information provided by the applicant and forwazded a response <br />by FAX on July 22, 1997. <br />On July 25, 1997, the Division received a letter from the SHPO conceming site SLA7194. The <br />SHPO determined that this site would not be affected by project activities. However, if project <br />plans change, this site may need testing completed. <br />On July 29 and August 1 the Division received responses to the remaining issues as defined in <br />the Division's July 22, 1997 correspondence. <br />On behalf on Lorencito Coal Company, Greystone Development Consultants requested, by FAX, <br />and extension of the due date for a decision by the Division to August 8, 1997. <br />The Division forwazded a final letter to Greystone Development Consultants on August 8, 1997. <br />
