<br />Item # 2 Amount - 5180.00 <br />Two hours TD-25 dozer at $90.00 per hr. to slope the new road through the north end 2% into <br />the hill This requires a change order as it was not required rn the Bid Documents or Contract. <br />I have asked for a change order on this but it was denied, and as of yet it is unbilled CR'L was <br />asked verbally to do this and again in the final inspection and certification of completion form. <br />The original road through this area had not particular slope in or out. It was just a rough mine <br />road full of ruts and rocks. <br />Response: The Bid Invitation Special Conditions, Task 8-North End Backfill and Grading, <br />specifies that "Upon completion of the backfilling and grading, the access road to the <br />Monarch Fan shall be reestablished as staked by the Project Manager and as indicated on <br />Map 7." Prior to road construction, the PROJECT MANAGER directed the <br />CONTRACTOR to slope the reestablished road through the north end 2 percent into the <br />hill. The Convactor was informed of the 2 percent grade requirement during the survey <br />work on April 22, 1994 during the time that Harry Ranney of the Division, the Project <br />Manager and Preston Mease were doing the survey on the North Slope for road alignment. <br />In fact, CWL's instrument was used during the survey. The road was constructed with either <br />0 percent grade or banked to the outslope. This is unacceptable road construction and was <br />rejected by the Project Manager which is the OWNER'S right for unacceptable work. The <br />OWNER does not believe that the CONTRACTOR is entitled to any additional money for <br />this roadwork. <br />FINDING: Task 8- North End Backfilling and Grading did not specify a 2% grade for the <br />new road. Other roads included in the bid did. Because of the lack of specificity for Task <br />8 in the bid documents, CWL is due $180.00. <br />Item # 3 Amount - 180.00 <br />Two hours of equipment rental TD-25 dozer at $90.00, to regrade an area just off the road at <br />the Magpie Division Crossing. This area was just outside CWL's equipment yard. On June 2nd, <br />DMG and people from Energy Fuel Coal had a meeting on the job to address the reclamation <br />ejj`ect on Energy Fuels mine. At that time Energy Fuels representative asked Jim McArdle to <br />re grade this area Jim told him CWL would. Jim later that day asked me to do this work At <br />that time I showed Jim pictures showing this was the original condition in that areq not <br />something we had done. It was made clear to DMC that this work was not our responsibility <br />and if they required us to do work in this area <br />employee do this work when I was of j` the site. <br />also was denied, and as of yet it is un-billed <br />we would be paid for it.
