<br />IlvIP concurred in my meeting with them, that they were paying topsoil costs beyond what <br />they had estimated, specifically due to the hourly rates paid to move the topsoil pile north <br />of Chen's Hill. Because of limited funds, the IMP had to delete tasks in order to pay for <br />the unanticipated hourly rates. So, although tasks were deleted, hourly rates were also <br />added. The end result was a reduction of the overall contract price. <br />Based on my meeting with IMP and the past correspondence, IMP has consistently <br />contended that the East Pit West Side topsoil pile was part of the lump sum estimate. This <br />is substantiated by the documentation. Tasks were not deleted to pay for moving this pile. <br />However, because of the Mr. Mease's claim that he should be paid hourly for it, the Project <br />Manager did keep rental records to monitor the item and equipment used moving it. <br />Based on all the information included in the bid document, I find Mr. Mease's allegation <br />referring to the special conditions of the Pre-Bid MeetinP and site showine to be <br />unsubstantiated. <br />The East Pit West Side topsoil pile is part of the lump sum bid. The Contractor is not owed <br />any money for moving this topsoil. <br />The balance owed for the retainage and these additional charger is $56,236.61. On August 26th <br />I met with John Nelson, Jim McArdle and Dave Buckram to discuss this and ask for <br />clarifications as to what was paid and what wasn't paid on my invoices. They could rtot explain <br />at the trme, as it proved to be unclear to them also. I later received in the mail; copies of my <br />invoices marked up and a spread sheet of line items that did not add up. These documents <br />cannot be interpreted, but it appears that none of the hourly equipment rental that occurred <br />after lone I4 was paid Also all of the retainage on this job rs still being held. <br />Response: John Nelson, Jim McArdle and Dave Buckram did not have all the necessary <br />information available at the meeting with the contractor to thoroughly discuss all amounts <br />paid on the contracture's invoices. The State is clear on what was paid on each invoice and <br />why. The Contractor has never brought to the State's attention any errors in the <br />spreadsheet or questions on bills. <br />The Contractor's retainage bill was received 11/25/94 and is currently being processed. <br />FINDING: During my meeting with Mr. Mease he said it was unclear to him what had <br />been paid and what had not. IMP documentation presented to me is clear about what has <br />been paid. The retainage bill is being processed. <br />Costs for moving the East Pit West Side Pile are part of the lump sum topsoiling prices. <br />Hourly rates have been paid to cover the costs of moving the Chen's Hill North Pile and the <br />East Pit Yazd Pile. No additional money is due for hourly equipment rental. Retainage is <br />due to CWL. <br />No payment is due for Claim #1. <br />10 <br />
