CYCC has not recovered 174,000 tons of coal which it <br />had proposed to recover in the original permit. <br />Only reclamation work has been done on the property since the permit was <br />issued. CYCC has sealed and backfilled the Middle Creek underground mine <br />portal area. Backfilling and rough grading of all other areas of the mine was <br />completed in 1986. Topsoil redistribution was completed in 1986 for all parts <br />of the mine except the Middle Creek office area. Seeding has been done on all <br />areas except 13.5 acres at the southern edge of the property and the Middle <br />Creek office area. The operator intends to complete seeding of all areas <br />except the Middle Creek office area in the spring of 1987. <br />CYCC has completed reclamation work on two permanent detention basins (M3-N <br />and M3-S). CYCC backfilled two mine pits and installed dewatering devices to <br />prepare the ponds for the dual purpose of sediment control and stock <br />watering. Approval of the ponds as permanent impoundments was given in <br />February, 1987 (TR-03). <br />No reclamation is to take place at the Middle Creek office area until 2005. <br />Reclamation of the Middle Creek office area provides for removal of the <br />structure and restoration of the essential hydrologic functions of the <br />alluvial valley floor that the office complex currently occupies. <br />Review of enforcement actions taken against CYCC by the Division indicates <br />that no outstanding reclamation violation exist at Mine #3. Several <br />reclamation problems exist on the property. CYCC has had problems with <br />sediment control and excessive erosion. Problems with sediment control have <br />been effectively mitigated by installation of dewatering structures in <br />detention pond M3-S and M3-N. Erosion problems are expected to decrease as <br />the area is revegetated and stabilized. <br />II. Decision to Require Revisions <br />The Division finds that certain revisions and modifications at the CYCC Mine <br />No. 3 are required to ensure the future compliance of the mine with the <br />Colorado Coal Mining Reclamation Act and the Rules and Regulations at the <br />Mined Land Reclamation Board. The decision to require the revision is based <br />on the Division's mid-term review. The requested revisions should be <br />submitted as technical revisions within sixty days of receipt of this <br />document. A description and justification of each revision is presented below. <br />A. Middle Creek Office Complex Reclamation Plan <br />The current reclamation plan for the Middle Creek Office area calls <br />for removal of the structure and reclamation of the area in 2005. <br />The structure must be removed and the site restored to the essential <br />hydrologic function of an alluvial valley floor per Rule 4.24.2(2). <br />The CYCC Mine No. 3 permit application and information submitted to <br />satisfy Stipulation No. 5 indicates that this area is to be <br />reclaimed per the reclamation plan in section 2.05.4. The <br />reclamation plan does not specifically address reclamation <br />activities related to the office complex.
