monitoring shall be submitted to the Division within 30 days
following completion of each monitoring episode.

Stipulation No. 32
The applicant shall continue to submit to the Division an annual
report of inflows, discharges and consumption of water within the
mine. Amine workings map, showing the source (fault, fracture,
etc.), quantity, duration and quality of inflows, shall only be
required if there are measurable inflows to the mine during the
year. Records of water discharged from, consumed in, and imported
to the mine will also be included. The above information will be
submitted regularly with the annual hydrology report.

Stipulation No. 33
Bear Coal Company will, before initiation of mining permitted by
PR-O1 secure a signed Coal Lease agreement with ARCO granting Bear
Coal Company the right to mine coal in the B-seam in the E/2 SE/4
of Section 18, T135, R90W of the 6th P.M. Right of entry onto the
surface overlying this area must also be obtained.
This stipulation has been complied with through the submission of
a signed Coal Lease Agreement with the Alantic Richfield Coal
Company. This information has been incorporated into the permit
application and can be found in Volume 4, Exhibit 1.
Stipulation No. 34
The permittee will install a groundwater monitoring well downdip
from the mine workings and into the B-seam (between the fourth
north mains and the North Fork of the Gunnison River) for the
purposes of monitoring the potential effects of mining on the B-
seam aquifer. The final location and timing of installation will
be mutually agreed upon by the operator and the Division after
further field investigation, but installation shall occur no later
than August 31, 1995. Monitoring shall occur semi-annually for
field parameters and water level, and one full suite sample shall
be taken annually in the fall. The test parameters for the full
suite sample shall be the same as required for the alluvial wells
(table 4F) plus magnesium and SAR.
This stipulation has been complied with and is no longer active.
Upon further review, it was determined that any information
gathered from this well could be obtained from existing wells. In
addition, access to the proposed site was nearly impossible without
considerable additional disturbance. Therefore, the completion of
this well was deemed unnecessary. Details are provided in the
Division letter of November 20, 1995.
