<br />The original permit (C-81-033) was issued on July 19, 1982 and it <br />involved mining in the C-seam. On July 3, 1985, Bear Coal Company <br />submitted a permit revision proposing the additional mining of <br />C-seam coal under Federal Coal Lease C-0117192. This revision was <br />approved September 18, 1985. The first renewal application was <br />received on November 6, 1986 and following normal review procedures <br />was approved on June 18, 1987. A second renewal application was <br />received on January 16, 1992 and it was approved on January 22, <br />1993. Subsequent to these renewals, two permit revisions have been <br />approved. The first revision was submitted on December 1, 1993, <br />and requested the addition of 205 acres to the permit area. This <br />revision was approved on April 29, 1994. The second permit <br />revision was submitted on September 29, 1994 for a request to mine <br />additional B-seam coal in sections 16 and 20 of the permit area. <br />This revision (PR-02) was approved on February 8, 1995. <br />Since permit renewal there have been four notices of violation <br />issued to the Bear Coal Company as follows: <br />C-93-056 was issued on April 16, 1993 for failure to maintain an <br />access road. The violation was terminated on October 28, 1993 and <br />the total assessed penalty of $250.00 dollars was paid in full on <br />May 27, 1995. <br />C-93-074 was issued on May 12, 1993 for failure to transport and <br />place all coal waste in an approved area. The violation was <br />terminated on July 14, 1993 and the total assessed penalty of <br />$550.00 was paid in full on June 18, 1993. <br />C-93-075 was issued on May 12, 1993 for failure to maintain the one <br />foot freeboard requirement on the Bear No. 3 sediment pond <br />emergency spillway. The violation was terminated on September 8, <br />1993 and the total assessed penalty of $550.00 was paid in full on <br />June 18, 1993. <br />C-93-076 was issued on May 12, 1993 for failure to submit annual <br />hydrology data as required. The violation was terminated on June <br />18, 1993 and the total assessed penalty of $550.00 was paid in full <br />on June 18, 1993. <br />II. Summary of changes requested <br />There are several changes being requested as a result of this <br />review including changes to the reclamation bond which is discussed <br />in more detail in section IV of this document. In addition to or <br />in conjunction with the bond change, the Division is requesting <br />that Bear Coal Company submit a technical revision to incorporate <br />the requirements of stipulations No. 6, 21 and 32 into the <br />narrative of the permit application document in the appropriate <br />places. <br />
