The original permit (C-81-033) was issued on July 19, 1982 and it
involved mining in the C-seam. On July 3, 1985, Bear Coal Company
submitted a permit revision proposing the additional mining of
C-seam coal under Federal Coal Lease C-0117192. This revision was
approved September 18, 1985. The first renewal application was
received on November 6, 1986 and following normal review procedures
was approved on June 18, 1987. A second renewal application was
received on January 16, 1992 and it was approved on January 22,
1993. Subsequent to these renewals, two permit revisions have been
approved. The first revision was submitted on December 1, 1993,
and requested the addition of 205 acres to the permit area. This
revision was approved on April 29, 1994. The second permit
revision was submitted on September 29, 1994 for a request to mine
additional B-seam coal in sections 16 and 20 of the permit area.
This revision (PR-02) was approved on February 8, 1995.
Since permit renewal there have been four notices of violation
issued to the Bear Coal Company as follows:
C-93-056 was issued on April 16, 1993 for failure to maintain an
access road. The violation was terminated on October 28, 1993 and
the total assessed penalty of $250.00 dollars was paid in full on
May 27, 1995.
C-93-074 was issued on May 12, 1993 for failure to transport and
place all coal waste in an approved area. The violation was
terminated on July 14, 1993 and the total assessed penalty of
$550.00 was paid in full on June 18, 1993.
C-93-075 was issued on May 12, 1993 for failure to maintain the one
foot freeboard requirement on the Bear No. 3 sediment pond
emergency spillway. The violation was terminated on September 8,
1993 and the total assessed penalty of $550.00 was paid in full on
June 18, 1993.
C-93-076 was issued on May 12, 1993 for failure to submit annual
hydrology data as required. The violation was terminated on June
18, 1993 and the total assessed penalty of $550.00 was paid in full
on June 18, 1993.
II. Summary of changes requested
There are several changes being requested as a result of this
review including changes to the reclamation bond which is discussed
in more detail in section IV of this document. In addition to or
in conjunction with the bond change, the Division is requesting
that Bear Coal Company submit a technical revision to incorporate
the requirements of stipulations No. 6, 21 and 32 into the
narrative of the permit application document in the appropriate
places.
