_28_ <br />tl~e applicant observes that one-third of temporary stockpile No. 1 (155,000 <br />cubic yards) was originally derived from Dorchester's adjoining surface <br />facility area and should be returned to that area to complete reclamation of <br />both sites. G.E.C. has not, however, provided the necessary demonstration <br />that the material will be disposed of in an acceptable manner on this site. <br />Further, no mention is made of the disposition of the remaining two-Chirds <br />(310,000 cubic yards) of the material reported to be in temporary stockpile <br />No. 1. Also, on page 2.05-226, the applicant observes that three-fifths of <br />temporary stockpile No. 2 (234,000 cubic yards) will be backfilled into the <br />final pit of Che "current pit area" at the end of 1982. However, no dis- <br />cussion of the final disposition of the remaining two-fifths (155,000 cubic <br />yards) of the material in temporary stockpile No. 2 is made within the amended <br />permit application. <br />Additionally, the amended permit application commits to the reconfiguration <br />and reclamation of additional disturbed areas, such as the Newlin Creek drain- <br />age near the "North Pit," phases IV and V and the unnamed drainage between <br />phase I and III. However, no material balance information is presented to <br />indicate the material requirements involved in completing this reclamation.of <br />these previously disturbed areas. <br />In order to completely define the projected movement of overburden and inter- <br />burden material within the proposed mining operation, the following stipulation <br />is necessary' <br />11, PATERIAL BALANCE PROJECTIONS MUST BE PROVIDED FOR TEh1P0RARY STOCKPILES <br />1 AND 2, THE PREVIOUSLY DISTURBED PORTIONS OF THE DRAINAGE BETWEEN MINING <br />PHASES II AND II I, AND THE DISTURBED AREA OF NEWLIN CREEK WEST OF PHASES <br />IV AND V. IF EXCESS MATERIAL IS PROJECTED, DETAILED PLANS FOR HANDLING <br />OF THE EXCESS MATERIAL MUST BE PROPOSED. MATERIAL BALANCE PROJECTIONS <br />AND THE SPECIFIC PLANS FOR THE EXCESS MATERIAL, IF NEEDED, PiUST BE SUB- <br />MITTED TO THE DIVISION WITHIN 120 DAYS OF PERMIT ISSUANCE.. <br />XVII. Mine Facilities, Coal Handling Structures, Support Facilities - Rules <br />2.05.3(3), 2.05.3(7), and 4.04 <br />All mine facilities are within the proposed permit area as described in Section <br />2.05 and located on Plap 22 of the permit application. Part of the facilities <br />within the tipple area were constructed by a previous operation and are just <br />leased to G.E.C. If the property owner wishes to have the coal loading facil- <br />ities to remain intact, a letter requesting that they remain must be submitted <br />to the Division. Therefore, the following stipulation is necessary: <br />12. IF THE PROPERTY OWNER [dISHES TO HAVE CERTAIN COAL LOADING FACILITIES <br />REMAIN INTACT FOLLOWING COMPLETION OF MINING OPERATIONS, THEY MUST BE <br />REQUESTED IN A LETTER TO THE DIVISION. IF THE LETTER IS NOT RECEIVED <br />WITHIN 90 DAYS OF PERPIIT ISSUANCE, THE APPLICANT MUST REVISE THE BOND- <br />ING AMOUNT TO INCLUDE REMOVAL OF THESE FACILITIES. <br />
