2 The Review Process

<br />2.1 Initiation of Review
<br />The Division of Minerals and Geology (Division) initiated this internal review on December 3.
<br />1998.
<br />2.2 Reviewers
<br />Byron G. Walker and Janet Binns, Environmental Protection Specialists with the Division
<br />reviewed the Permit for adequacy.
<br />2.3 Status of Permit Stipulations
<br />Stipulations 1,2,3,4,6,7,8,9,10,11,12,13,14, ] x,16 and 18 of the original Permit were resolved
<br />during the first five-year permit term. Stipulations 19, 22 and 27 were resolved during the
<br />second five-year permit term. (Findings, 1992). Stipulations 20, 21, and 28 were resolved during
<br />the third five-year permit term (Findings, 1998). Stipulations 5, 17, 23, 26, 29, 30 and 31 were
<br />resolved in this current (fourth five-yeaz) permit term.
<br />The following stipulations aze in effect as of this review. The resolution of these stipulations by
<br />incorporation into appropriate sections of the Permit is a recommendation of this review.
<br />Stipulation No. 24. Each year, a minimum of one (1) representative fly ash and one (1)
<br />representative bottom ash sample shall be collected from the boilers at the Golden Power Plant.
<br />Laboratory analysis of the samples will consist of Toxics Characteristic Leaching Procedure tests
<br />(a replacement of the Saturation Extracts and E.P. Toxicity Tests sample cited in the Stipulation).
<br />Additional fly ash and bottom ash samples will be collected and analyzed if, at any time, a
<br />source of coal is changed. Results of the tests will be submitted to the Division within 15 days of
<br />permfttee's receipt of analysis reports. [Findings of Permit Renewal 2, 1992; Permit, 1991; TR 13

<br />Stipulation No. 25. An annual evaluation of ash disposal including, but not limited to, source of
<br />ash, ash quality, total amount of ash disposed of, average depth of ash and aerial extent of
<br />disposal areas, transportation and disposal techniques, water quality monitoring data, and future
<br />ash disposal will be included in the Annual Hydrology and Reclamation Report, Monthly reports
<br />consisting of source of ash, material quantities disposed of, depth of ash and aerial extent, water
<br />quality monitoring data, and disposal problems (if any) will be kept at the mine office and
