Section IV- Status of Stipulations <br />All six stipulations from the original permit have been complied with and there are no outstanding <br />stipulations. <br />Section V -Decision to Require Revisions <br />As a result of this midterm review, the Division will require revision(s) of the permit to address the <br />following concerns with the currently approved Carbon Junction Mine permit application. <br />1. DMG Application Form, pages 3 and 4. Please update the acreage amount to reflect current <br />conditions showing the total permitted acreage, affected acreage, and disturbed acreage. <br />2. Section 2.03.4 Please update the Identification of Interests sections to include the beginning <br />and end dates for each Officer/Director. <br />3. Section 2.03.5 Please update to compliance information to include all Notice of Violations <br />issued since the permit was issued. <br />4. Section 2.03.8 Please revise to reflect that coal mining operations have terminated and <br />include a detailed plan of the approved land use of industrial, commercial, and residential <br />with approved city and county permits, zoning requirements, and a schedule of <br />implementation. <br />5. Section 2.04.7(1) Update this section to reflect when wells 17B, 82-4, 82-5, 94-1, and 95-1 <br />were installed, the start and ending dates of sampling, and include the drill logs for each well. <br />6. Section 2.04.11 If the plan for the residential, commercial, and industrial land use disturbs a <br />significant portion of the existing mine permit, please update any impacts to threatened and <br />endangered species, as well as any plans to mitigate wildlife habitat that will be disturbed. <br />7. Section 2.05.4 Since the Division has not received any plans for any expansion or <br />developments, it is unclear what portions of the currently disturbed areas will be impacted, if <br />at all, and how these lands are to be reclaimed. Therefore this entire section for the <br />reclamation of mine related disturbances will need to be revised to incorporate any changes <br />to these areas caused by approved land use changes. These changes will include deviations <br />from approximate original contour, seed mix, and a definitive timetable for actual <br />reclamation to be completed prior to the expiration of this permit term. <br />8. Section 2.05.5 Post Mining Land Use. This section was revised in 1996 to reflect the change <br />to residential, commercial, and industrial land use, however, for the past 5 yeazs, with the <br />exception of [he small parcel of land released for the golf course (which has ceased <br />development for the last 18 months), nothing has changed about the coal mine and the gravel <br />permit operations. If the operator still plans to develop the site, then please update this <br />section to reflect what will happen with the land and include a timetable of implementation. <br />9. Section 2.05.6(2) As stated above, if the operator plans to disturb a significant portion of the <br />mine permit area's wildlife habitat, then revise this section to include a wildlife mitigation <br />plan. <br />
