.~: <br />In September 1996, a revision to the permit changed the land uses from agriculture and wildlife habitat <br />to industrial, commercial, and residential. This was deemed feasible due to the demand for residential <br />housing in the Durango area, and that the fact that the Ewing Mesa gravel pit became operational inside <br />the coal permit boundary in early 1993. <br />Although no coal was mined, the permit was renewed in 1998 with the expectation that market <br />conditions would be favorable in the near future to warrant resuming mining operations. <br />Since the permit was renewed, coal has not been produced, and gravel operations have depleted <br />virtually all of their permitted resources. Therefore, the Division is requiring Oakridge Energy to <br />modify the permit to reflect that coal mining operations have terminated, and that industrial, <br />commercial, and residential use is the approved land use, and that all reclamation of coal disturbances <br />will be reclaimed prior to the end of this permit term. <br />Section 77-History of Violations <br />A review of the inspection and enforcement activities during the first half of the permit term was <br />conducted.
