RECORD OF COMMUNICATION <br />TO: JIM STEVENS. DMG <br />PAGE 2 <br />permit that Fremont Paving and Readimix was operating under. He suggested that I call <br />Canon City Fire Chief Dan Brixey (719) 275-8666. <br />7/28/95, 10:00 - I telephoned Fremont Paving and Readimix (719) 275-3264 and asked to <br />speak with Mr. Jim Airy, owner of the company. I was told that Mr. Airy was on vacation <br />and was asked if I would like to speak to Mr. Harvey Barnhart. Mr. Barnhart indicated that <br />the facility had an Open Pit Mine Permit in the name of the MacKenzie Pit, 839 MacKenzie <br />Avenue, Canon City, Colorado. Mr. Barnhart could not find a copy of the mining permit. <br />He did report to me that the U.S. Department of Labor MSHA ID number, for the site was, <br />OS-00977-05519. I left my name and telephone number with Mr. Barnhart, he indicated he <br />would ask Mr. Airy to call me when he returned from vacation. <br />7/28/95, 10:]5 - I telephoned Canon City Fire Dept. and asked to speak to Chief Brixey, <br />I was told that he was out and would not be in the office until Monday July 31, 1995. I left <br />my name and telephone number and requested that he give me a call when he returned to <br />the office. <br />7/31/95, 9:40 -Canon City Fire Chief Dan Brixey telephoned me. We discussed [he <br />incident and he informed that the Fremont County Sheriff was the DERA (Designated <br />Emergency Response Agency) for the site. He further indicated that, to the best of his <br />knowledge, Deputy Bart Adams was investigating the case and was going to obtain a copy <br />of the facility's permit. <br />7/31/95, 9:53 - I telephoned Fremont County Sheriff Del Rea and told him of my <br />conversation with Fire Chief Brixey. Sheriff Rea concurred with Chief Brixey's <br />understanding that Deputy Adams was investigating the case. Sheriff Rea indicated he <br />would have Deputy Adams contact me. <br />7/31/95, 11:03 -Deputy Adams telephoned me. He indicated that he had requested <br />Fremont Paving and Readimix to provide him a copy of their mining permit to demonstrate <br />that they were allowed to dispose of wastes on-site. He indicated that Fremont Paving and <br />Readimix had failed to produce that document. <br />8 f 2 f 95, 14:50 - I called Jim Stevens, DMG, and informed him of what I had learned about <br />this incident and inquired if DMG had knowledge of this site and if so what disposal <br />activities would be allowed. Mr. Stevens indicated that DMG did have a file on the <br />MacKenzie Pit. Mr. Stevens requested me to compile this information and forward it to <br />him. <br />8/10/95, 14:50 - During a landfill inspection trip, Sid Darden, Fremont County <br />Environmental Health Officer, and I stopped at the location of Fremont Paving and <br />Readimix. The site is located along the northeast side of Highway 115, near the community <br />
