MID-TERM REVIEW
KING COAL MINE

This document presents the results of the Division's Mid-Term Review of
National King Coal Incorporated's Kina Coal Mine. The mid-term review was
conducted to fulfill the requirements of Rule 2.06.2(9), 2.06.3(4), 2.06.5(31,
2.06.7(5), 2.08.3 and 3.02.2(4).
Rules 2.06.2, 2.06.3, 2.06.5 and 2.06.7, require that experimental practices,
mountain top removal variances, variances from AOC, and variances for delay in
contemporaneous reclamation requirements in combined surface and underground
mining operations be reviewed by the Division where applicable during the
Mid-Term Review. None of the special categories listed above apply to
operations at the King Coal Mine.
Rule 2.08.3 requires that the Division conduct a review of each permit issued,
prior to its mid-term (2 1/2 years). Based on this review, for good cause
shown, the Division may require reasonable revision or modification of the
permit provisions to ensure compliance with the Act and Regulations.
Rule 3.02.2(4) requires that the Division review the amount of the financial
warranty and the terms of acceptance of the financial warranty every
2 1/2 years. Based on this review, for good cause shown, the Division may
require adjustment of the financial warranty to ensure compliance with the Act
and Regulations.
This Mid-Term Review consisted of a detailed review of the King Coal Mine
Permit and Findings document to identify any items that may have been
overlooked during the initial review. The Division also reviewed all
subsequent revisions to ensure that all permit commitments and conditions were
being followed. Problems and observations from past inspection reports and
enforcement actions were also considered.
Section I -'History
Renewal No. 1 to Permit C-81-035 was issued to National King Coal, Inc. (NKC)
effective August 18, 1987. The proposed Decision and Findings of Compliance
was issued on July 9, 1987. The mine has been active during the period, with
coal production remaining relatively constant.
There were no stipulations attached to the renewal permit. All stipulations
attached to the original, 1982 permit had been resolved prior to issuance of
the renewal permit.
Section II - Revisions to the Permit
Since permit issuance, the Division has approved one permit revision and four
minor revisions to the permit. These revisions are listed below in
chronological order. A second permit revision was submitted and determined to
be complete shortly before this midterm document was prepared. No decision on
the second permit revision has yet been made.
