_1 • <br />MID-TERM REVIEW <br />KING COAL MINE <br />FILE N0. C-81-035 <br />This document presents the results of the Division's Mid-Term Review of <br />National King Coal Incorporated's Kina Coal Mine. The mid-term review was <br />conducted to fulfill the requirements of Rule 2.06.2(9), 2.06.3(4), 2.06.5(31, <br />2.06.7(5), 2.08.3 and 3.02.2(4). <br />Rules 2.06.2, 2.06.3, 2.06.5 and 2.06.7, require that experimental practices, <br />mountain top removal variances, variances from AOC, and variances for delay in <br />contemporaneous reclamation requirements in combined surface and underground <br />mining operations be reviewed by the Division where applicable during the <br />Mid-Term Review. None of the special categories listed above apply to <br />operations at the King Coal Mine. <br />Rule 2.08.3 requires that the Division conduct a review of each permit issued, <br />prior to its mid-term (2 1/2 years). Based on this review, for good cause <br />shown, the Division may require reasonable revision or modification of the <br />permit provisions to ensure compliance with the Act and Regulations. <br />Rule 3.02.2(4) requires that the Division review the amount of the financial <br />warranty and the terms of acceptance of the financial warranty every <br />2 1/2 years. Based on this review, for good cause shown, the Division may <br />require adjustment of the financial warranty to ensure compliance with the Act <br />and Regulations. <br />This Mid-Term Review consisted of a detailed review of the King Coal Mine <br />Permit and Findings document to identify any items that may have been <br />overlooked during the initial review. The Division also reviewed all <br />subsequent revisions to ensure that all permit commitments and conditions were <br />being followed. Problems and observations from past inspection reports and <br />enforcement actions were also considered. <br />Section I -'History <br />Renewal No. 1 to Permit C-81-035 was issued to National King Coal, Inc. (NKC) <br />effective August 18, 1987. The proposed Decision and Findings of Compliance <br />was issued on July 9, 1987. The mine has been active during the period, with <br />coal production remaining relatively constant. <br />There were no stipulations attached to the renewal permit. All stipulations <br />attached to the original, 1982 permit had been resolved prior to issuance of <br />the renewal permit. <br />Section II - Revisions to the Permit <br />Since permit issuance, the Division has approved one permit revision and four <br />minor revisions to the permit. These revisions are listed below in <br />chronological order. A second permit revision was submitted and determined to <br />be complete shortly before this midterm document was prepared. No decision on <br />the second permit revision has yet been made. <br />
