An extra category, "Biennial or Perennial Weed <br />Species" should be established and defined (to include only certain <br />species such as Canada Thistle, Bull Thistle, Fox tail Barley and <br />others) to allow this negative suite of species to contribute, if <br />it exists, to the similarity of reclaimed and reference areas. <br />E. "Grasslike Plants" should be established as a category to keep <br />sedges and rushes from being included in one of the three grass <br />categories. <br />In summary, should WECC opt to stay with a similarity index in lieu <br />of amore standard species diversity index, the above issues must <br />be newly addressed or incorporated. Should WECC opt not to <br />continue to use a similarity index, WECC must address a new way to <br />comply with the species diversity requirements of 4.15.8(5). <br />Alternative methods for compliance are addressed on pages 13 and 14 <br />of the "Guidelines for Compliance with Land Use and Vegetation <br />Requirements of the Colorado Mined Land Reclamation Board" prepared <br />in October of 1988. <br />General Mine Plan Compliance <br />1. Thirty-five (35) stipulations are associated with the latest copy <br />of the permit. Twenty-two are still outstanding. West Elk Coal <br />Company may address these stipulations within the permit <br />application either as approved plans or as commitments for future <br />submittals. <br />
