The repon (attached) iadirates probable water righu issues, includ'wg two <br />ponds seated in the southern pit area exposing ground water and ground weer or surface nmoff <br />intercepted by a cut bank in the northwest comer of the pit. We have not identified a permit or <br />Substitute Water Supply Plan for any of this operation's activities. The operator also screens and <br />washes excavated muerial using an unknown weer source which may nac be pemutted or decreed <br />for industrial use. <br />Please inspett the site and review a~ information you may have to de[era[ine <br />• the estimated ground water exposed in the ponds (or if the ponds atise from a surface water <br />source), <br />• the water source and extent/impatt of the "seep" and any proposed remedial attioa, <br />• the water source(s) for their operations and the legaGry of such use, <br />• identify any decrees, permits, or SSP's you maybe aware of for the operation, and <br />• any[hiag else you believe would be useful in evaluating compliance. <br />You may want to con[ad Jim Dillie, the CDMG ivspettor, at (303) 866.3567, for additional lontion <br />and operations information or to accompany you. If found in noncompliance, we will use the <br />infomration gathered at your and CDMG's inspettions [o drab a letter ordering them to cake actioxs <br />to achieve wmpliance with statute. As additional background information, I have enclosed copies of <br />previous (so[neurtnes maflicting) inspections and a past fetter, for which we received no mpodse. <br />Thank you For your assistance.
