<br />material by the Department of Health is required. <br />The special use permit is considered a legal and binding document <br />to the mining and reclamation permit as is any other local, state, <br />or federal permit that is necessary to conduct the mining and <br />reclamation operations (Rule 2.05.4(2)(h)). As the lead agency <br />responsible for compliance with the final reclamation of the <br />Keenesburg Strip Mine, part of that responsibility is to coordinate <br />reviews with federal agencies, other state agencies, and local <br />government entities for any significant changes to the mining and <br />reclamation plan. The Division considers the wholesale change of <br />the coal source and the ash waste product to be a significant <br />change to the reclamation plan at the Keenesburg Strip Mine. <br />If CEC has changed to a different coal supply (as stated in your <br />letter of March 15, 1995) the Division will expect a technical <br />revision to be submitted within 30 days of receipt of this letter. <br />The revision should contain, at a minimum, analysis of the new <br />waste ash for the parameters outlined in stipulation 27 and <br />evidence of notification of the change in the coal supply to the <br />Hazardous Materials and Waste Management Division of the Colorado <br />Department of Health and the weld County Health Department. <br />If you have any questions or require additional information <br />concerning this issue, please contact me. <br />Sincerely, <br />~~ <br />Anthony J.
