SUMMARY OF TXE REVIEW PROCESS <br />The King Coal mine, located in Sections 31 and 32, T35N, RI1W, LaPlata <br />County, Colorado, has been in existence since 1991 and is currently open <br />ating under a permit (Number 79-37) issued on December 8, 1980 by the <br />Colorado Mined Land Reclamation Board. <br />On February 17, 1981, National King Coat submitted a permit application to <br />bring the King Coal mine into compliance with the Colorado State Program. <br />The following items summarize the review of this application: <br />- Application deemed complete on February 27, 1981; <br />- Complete application placed on file in the LaP2ata County Courthouse; <br />- Notice of complete permit application published in the Durango <br />Herald on July 23, July 30, August 6 and August 13, 1981; <br />- Preliminary adequacy review from the Division sent to National zing <br />Coal on April 27, 1981, delineating those deficiencies requiring <br />resolution for compliance with the State program; <br />- On June 1, 2981, representatives of National King Coal and the <br />Division met at the mine to discuss issues raised in the preliminary <br />adequacy review; <br />- Responses to the preliminary adequacy review were submitted by <br />National King Coal on October 8, 1981; <br />- On November I8, 1981, another meeting was held with representatives <br />of National King Coal and the Division to discuss the remaining in- <br />adequacies with the permit application; <br />- On January I9, 1982, National King Coal submitted additional infor- <br />mation addressing the inadequacies discussed at the November meeting; <br />- On February 23, 1982, the Division found the application to be in <br />compliance with the Colorado State Program and issued this proposed <br />decision approving the application. <br />Correspondence detailing the nature of this review process is on file for <br />public inspection at the office of the Division. <br />It should be noted that on October 16, 1979, National King Coal applied for <br />emergency lease C-29125. The Lease, managed by the Montrose District of the <br />Bureau of Land Management, was subsequently awarded to National King Coal on <br />October 29, 1981. The new Lease area was the subject of an Environmental <br />Assessment by the BLM, and was included in the permit review process noted <br />above. <br />
