PROPOSED DECISION <br />KING COAL MINE <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />stipulations, an application for a permit to conduct coal mining at the <br />King Coal mine. The mine is located in Sections 3I and 32, T35N, RI1W, <br />LaPla to County, Colorado. <br />This approval decision is based on a finding that the proposed operation <br />will comply with alI requirements of the Colorado State Program as found <br />in Colorado Surface Coal Mining Reclamation Act, C.R.S. 1973, as amended, <br />34-33-101 et, seq., and the Regulations promulgated pursuant to the Rct. <br />If no requests for a formal hearing are made within 30 days of the issuance <br />of this proposed decision, then this decision becomes final and upon <br />acceptance by the applicant, the permit application and stipulations con- <br />tained herein will become a binding part of the permit. Stipulations for <br />the King Coal mine are as follows: <br />1. NATIONAL KING COAL MUST MONITOR WATER LEVELS AND WATER QUALITY <br />IN THE ALLWZRL AQUIFER OF HAY GULCH ON A QUARTERLY BASIS. THE <br />EXISTING MONITORING WELL WILL BE ADEQUATE FOR THESE PURPOSES ONCE <br />THE FOLLOWING ITEMS ARE SATISFIED: <br />R) THE TOP OF THE WELL MUST BE SEALED TO PREVENT SURFACE WATER <br />AND OTHER DEBRIS FROM ENTERING THE WELL CASING; <br />B) MONITORING SHOULD ONLY OCCUR ON MONDAY MORNINGS AFTER THE WELL <br />HAS SET IDLE FOR AN ENTIRE WEEKEND. NATIONAL KING COAL MUST MONITOR <br />FOR THE FOLLOWING WATER QUALITY PARAMETERS: <br />pH MAGNESIUM <br />CONDUCTIVITY SULFATE <br />TEMPERATURE IRON <br />TOTAL DISSOLVED SOLILtS PIANGRNESE <br />CALCIUM <br />C) THE RESULTS OF THIS WATER LEVEL AND WATER QUALITY MONITORING <br />SHALL BE SUBMITTED TO THE DIVISION ON A QUARTERLY BASIS. <br />2. NATIONAL KING COAL MUST PREPARE A MASS BALANCE DEMONSTRATION TO <br />CLARIFY THE INDICATED SOURCES OF MATERIAL TO BE USED TO BACKFILL <br />AND REGRADE THE SURFACE FACILITIES RRER. SUCH DEMONSTRATION <br />SHALL INCLUDE AN AMENDED DESCRIPTION OF MATERIAL SOURCES AND TECH- <br />NIQUES OF MATERIAL PLACEMENT TO BE UTILIZED. VOLUME CALCULATIONS <br />SHALL BE COMPLETED DETAILING THE VOLUME OF FILL REQUIRED RND THE <br />VOLUME OF MATERIAL TO BE OBTAINED FROM EACH SOURCE, SUCH AS SALVAGE <br />OF EXISTING BENCHES, DEPOSITION OF UNDERGROUND DEVELOPMENT WASTE <br />AND ROOF FALL, DEPOSITION OF SEDIMENT FROM SEDIMENT PONDS AND THE <br />DISPOSAL OF DEMOLISHED SURFACE FACILITY DEBRIS. THIS MASS BALANCE <br />EXPLANATION SHALL BE SUBMITTED TO THE DIVISION WITHIN 60 DAYS <br />FOLLOWING THE ISSUANCE OF THE APPROVED PERMIT. <br />
