CHP~NGES FOLLOWING PUBLIC NOTICE (Continued) <br />The: last discussion item from permittee's comment letter was regarding Whole <br />Ef1.`luent Toxicity (WET) testing requirements of this permit. The owners of <br />the: Bates Hunter mine do not feel that the WET tests proposed in the permit <br />are: appropriate. Reference was made to the Clear Creek/Central City Superfund <br />Site Operable Unit (j3 Record of Decision regarding that •the receiving stream, <br />Gregory Gulch, is incapable of supporting aquatic life of any form including <br />fathead minnows or Ceriodaphnia." However, regardless of the quality and <br />characteristics of the receiving stream, the permittee is still required to <br />perform WET testing and this permit is subject to acute WET limitations. This <br />is required in the Reeulations for the State Discharl{e Permit Svstem (6.1.0), <br />as is previously discussed in this rationale. Thus, no changes have been made <br />in the permit or rationale with respect to WET limitations and WET testing <br />requirements. <br />Don Holmer <br />June 30, 1992 <br />
