Summary of the Review Process <br />Energy Fuels Mining Company submitted its Phase I Bond Release Request to DMG on <br />August 11, 1995. The Division found the request incomplete on August 17, 1995. Items <br />needed for completeness were proof of publication of the notice regarding submittal of the <br />application, and proofs of mailing the notice of submittal to overlying and adjoining <br />property owners, and to the appropriate local governmental agencies, commissioners, and <br />water and sewer districts. <br />Proofs of notification to the landowners and governmental agencies were submitted by <br />EFMC to DMG on November I5, 1995. Public notice regarding the submittal was pub- <br />lished once per week for four consecutive weeks in the Chronicle-News, a local newspaper, <br />between October 30, 1995, and November 20, 1995. An affidavit of publication was <br />received by the DMG on November 30, 1995. The bond release application was deemed <br />complete by DMG on December 5, 1995. <br />During the adequacy review of the bond release application, it was determined that the <br />landownership information in the Raton Creek Mines permit needed updating. This <br />information was provided by EFMC on December 7, 1995, and was found appropriate. <br />A Phase I Bond Release Inspection of the three areas requested for release was conducted <br />on December 20, 1995. A review of the mine site records found a copy of the bond <br />release application on file. Also on file was a copy of the proof of the mailing of the <br />application to the County Planner. <br />Present at the inspection were Mr. A.J. Iuppa (a surface and mineral owner), Mr. Nick <br />Cimino (a surface and mineral owner), Mr. Clint Carey (EFMC representative), and <br />Mr. Dan Hernandez (DMG representative). Mr. Henry Austin, a representative of the <br />U.S. Office of Surface Mining (OSM), Lad telephoned DMG on December 14, 1995, to <br />inform DMG that OSM would not be attending the inspection. <br />V. Observations <br />A. Substation Area <br />This area was comprised of a disturbance of approximately 4000 square feet in extent. <br />It consisted of two regraded slopes: one around the southern edge of the former sub- <br />station area, and another around the western edge.
