<br /> <br />Claimant holding a valid reclamation claim against it is entitled <br />to an administrative expense under Section 503 (b) of the <br />Bankruptcy Code against the Debtor's estate for the amount listed <br />in the ^COUrt Approval" column of Exhibit A. <br />14. CFI Steel believes that significant and <br />unproductive litigation costs may be avoided through this motion. <br />15. CFSI Steel, upon approval of this motion, will pay <br />valid claims allowed as administrative claims, subject to <br />availability of cash. <br />16. CF&I requests that the Court order that the claims <br />of Reclamation Claimants who filed proofs of claim in this case <br />(or related cases) which reflect amounts for goods subject to <br />reclamation and who receive payment pursuant to this motion for <br />such goods, be reduced by the amount of the payment received by <br />them. In the memorandum accompanying this Motion, CF&I Steel <br />lists the persons whom it believes should be ordered to so adjust <br />their claims. <br />WHEREFORE, CF&I Steel requests this Court (lj to determine <br />that those reclamation claims listed in the "Court Approval" <br />column of Exhibit A are valid reclamation claims, (2) to <br />~ determine that those reclamation claims listed in the "Invalid <br />Claim" column of Exhibit A are invalid reclamation claims, (3) to <br />determine that the amounts of the valid reclamation claims are <br />those set forth in Exhibit A to the Memorandum, and (4) to grant <br />priority claims pursuant to 11 U.S.C. §546(c)(2)(A} to the valid <br />reclamation claims and allow the Debtor to pay such valid claims <br />5 <br />
