"'• <br />17 <br />Staff said that the Division does differentiate between a <br />surety and a permit holder, with regard to bond release, etc. <br />Staff said the Division considered Harrison-Western as a <br />surety and the Dr. Corley was a permittee. Staff discussed <br />this situation in detail and answered questions from the <br />Board. <br />Doctor Corley briefly discussed another matter which involved <br />IML Staff and his allegation of trespass and falsification of <br />documents. <br />The Board denied Doctor Corley's request for full performance <br />bond release at this time. <br />20. FORMAL PUBLIC HEARING <br />ZMK MINE CONSTRUCTION, INCORPORATED File No. M-91-146 <br />Pete Klein & Richard Zanett. Staff stated that this matter <br />related to a request from the operator that the Board <br />reconsider a previous permit approval. <br />Staff said the Division approved the operator's Board ordered <br />application for a permit on March 18, 1992, and that the <br />operator failed to submit the financial warranty within one <br />year of the permit approval. Staff explained that Rule 7.22 <br />prohibits the issuance of a permit until the Board or Division <br />receives the performance and/or financial warranties required. <br />If the warranty (s) is not submitted within one year of the <br />approval, the Board is required to hold a hearing to <br />reconsider the previous permit approval. <br />Staff recommended that the Board consider the Division's <br />previous approval and that it be reaffirmed. <br />Staff stated that the operator provided notice of this matter <br />and that no objections were received by the Division. Staff <br />said the conditions at the site remain the same as during the <br />initial permit approval. <br />Mr. Rich Miers briefly addressed the Board on behalf of the <br />operator. He stated the residents in the area who previously <br />objected to the proposed operation have, basically, withdrawn <br />those objections. Mr. Miers explained that do to some <br />environmental problems in the area, including flooding from <br />runoff, the residents have requested that the operator provide <br />some assistance to resolve the problems, <br />The Board granted the operator's request and reaffirm the <br />previous permit approval. <br />
