<br />1s <br />signed for work to be conducted on a portion of Dr. Corley's <br />property. Doctor Corley also alleged that trespassing had <br />occurred on his property. <br />Mr. Long said that Dr. Corley stated wanted the reflect that <br />he had submitted a timely request for the Board to consider <br />this matter. <br />In response to an inquiry from the Board, Mr. Long said that, <br />based on the letter, the Division agreed that Dr. Corley <br />submitted a complaint in early August clarified that Dr. <br />Corley's complaint, as stated in his letter, related to the <br />issue of trespass on his property. He said the Division plans <br />to investigate Dr. Corley's complaint. However, Mr. Long said <br />that, at this time, the Division was not prepared to go <br />forward with this matter. He requested that the Board <br />continue this matter to the a future Board Meeting and allow <br />the Division time to investigate the matter. <br />In response to a question from the Board, Dr. Corley stated <br />that he was prepared to go forward with the matter at this <br />time. However, he stated that he would not object to the <br />Division's request to continue the matter to a future Board <br />Meeting. <br />The Board continued this matter to the October 1993 Board <br />Meeting. <br />18. FORMAL PUBLIC HEARING <br />THE CORLEY COMPANY File No. C-81-037 <br />Doctor W. D. Corley, the operator, provided the Board with <br />background information, regarding this matter, which related <br />to his request that the Board establish a time schedule for <br />completion of reclamation work on a revoked site. <br />Doctor Corley stated that when a previous operator, GEC, <br />ceased operations about 1983, the permit was revoked, with a <br />considerable amount of disturbance being left at the site. He <br />said that a portion of the disturbance, related to an area <br />called Section 24, will be reclaimed in September of this year <br />by the Division. The bidding process for the work on Section <br />24 was completed last week. However, he said he was concerned <br />that the bond remaining after reclamation of Section 24 would <br />not be adequate for the remaining reclamation of the East Pit. <br />Doctor Corley showed slides and discussed a coal mining <br />company in the area, Energy Fuels, and the possibility of that <br />company depositing its coal waste into the pit, rather than <br />backfilling. <br />Staff clarified that, according to the State statute, it would <br />be illegal for a permitted operation to deposit waste on an <br />
