M-2003-037 <br />THIS MATTER came before the Colorado Mined Land Reclamation <br />Boazd ("Board") on January 20, 2004 in Denver, Colorado to consider the request by <br />Haldorson and Sons, Inc. ("Applicant"), File Number M-2003-037, to grant the <br />Applicant's Petition for Reconsideration ("Petition"). <br />The Board, having considered the Petition and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following findings of fact, <br />conclusions of law and order: <br />On January 20, 2004, the Board voted to hear oral argument concerning <br />the Petition at its upcoming meeting scheduled for February 25-2b, 2004. <br />The Board's attorney set forth a procedure for the February hearing in a <br />letter to the parties dated January 22, 2004. <br />2. On or about January 23, 2004, the Board was informed that the attorney <br />for Friends of Spring Creek, the party objector in this matter, is unable to <br />attend the Board's February meeting due to aprior-scheduled conflict. <br />The objector's attorney requested a continuance in this matter so that she <br />could attend the hearing where the Board will consider the Petition. <br />3. The Board is authorized under the Administrative Procedures Act, § 24-4- <br />101 et seg. C.R.S. (2003), to "set the time and place for continued <br />GI ~ <br />
