Ms. Paula Steelman - 2 - July 1, 1988 <br />On February 23, 1988, a meeting with Andersen Construction was held at the <br />offices of the Mined Land Reclamation Division. It was agreed that if <br />certain materials were submitted by March 15, 1988, the Division would <br />recommend to the Board that the Cease and Desist order be lifted and that the <br />total assessed Civil Penalties be reduced by 504. <br />On March 21, 1988, the Mined~Land Reclamation Division, after reviewing all <br />items submitted by Midway Sand and Gravel and Andersen Construction, approved <br />a Succession of Operators for Site Nos. M-80-086 and M-80-156 from Andersen <br />Construction to Midway Sand and Gravel. <br />On April 27, 1988, the Mined Land Reclamation Board, after reviewing the case <br />histories of the two former Andersen Construction sites, determined that the <br />previously unsuspended 513,300 of the assessed Civil Penalites (58300 for Site <br />No. M-80-86 and 55000 for Site No: M-80-156) would be payable by <br />June 4, 1988. <br />To date, the Mined Land Reclamation Division has not received a penalty <br />payment.
