Dear Ms: Steelman:
The Colorado Mined Land Reclamation Board, at its August, 1987 meeting, found
that Andersen Construction had conducted mining operations outside of its
permitted boundaries at two mining sites, M-80-086 and M-80-156, in violation
of the Colorado Mined Land Reclamation Act. Notices of Violation and Cease
and Desist Orders were issued. Corrective actions required Anderson
Construction to amend its existing permits to include all disturbed areas
within a single permit area by the October; 1987 Board, meeting. Consideration
of Civil Penalties was deferred to the October meeting.
At the October Board meeting, Anderson Construction was assessed two Civil
Penaliies in the amount of 516,6D0 per site, totalling 533,2D0. The Board
decided to suspend 58300 (500) of the penalty against Site No. M-80-086 (NDV
No. M-87-037) if Andersen submitted an application for a Mining and
Reclamation Permit or a Reclamation-Only Permit by the January, 1988 Board
meeting. If Andersen were to fail to do so, the suspended 58300 would be
payable on January 21, 1968. In addition, the unsuspended 58300 for Site No.
M-80-086 would be payable by December 9, 1987.
As for Site No. M-BO-156 (NOV N-87-036), the Board decided that 511,600 of the
516,600 Civil Penalty would be suspended if Andersen Construction filed an
amenement to its existing permirt to include the i5 acres of disturbance that
currently lay outside the permit boundary by December 1, 7987_ If Andersen
were to flail to do so, the suspended 55DDD would be payable by December 9,
1987.
On January 21, 1988 the Division received a request from Andersen Construction
to extend its deadline for corrective action. The Division granted an
extension to the February, 1988 Board meeting.
