M-BO-86 and M-80-156 <br />Dear Ms: Steelman: <br />The Colorado Mined Land Reclamation Board, at its August, 1987 meeting, found <br />that Andersen Construction had conducted mining operations outside of its <br />permitted boundaries at two mining sites, M-80-086 and M-80-156, in violation <br />of the Colorado Mined Land Reclamation Act. Notices of Violation and Cease <br />and Desist Orders were issued. Corrective actions required Anderson <br />Construction to amend its existing permits to include all disturbed areas <br />within a single permit area by the October; 1987 Board, meeting. Consideration <br />of Civil Penalties was deferred to the October meeting. <br />At the October Board meeting, Anderson Construction was assessed two Civil <br />Penaliies in the amount of 516,6D0 per site, totalling 533,2D0. The Board <br />decided to suspend 58300 (500) of the penalty against Site No. M-80-086 (NDV <br />No. M-87-037) if Andersen submitted an application for a Mining and <br />Reclamation Permit or a Reclamation-Only Permit by the January, 1988 Board <br />meeting. If Andersen were to fail to do so, the suspended 58300 would be <br />payable on January 21, 1968. In addition, the unsuspended 58300 for Site No. <br />M-80-086 would be payable by December 9, 1987. <br />As for Site No. M-BO-156 (NOV N-87-036), the Board decided that 511,600 of the <br />516,600 Civil Penalty would be suspended if Andersen Construction filed an <br />amenement to its existing permirt to include the i5 acres of disturbance that <br />currently lay outside the permit boundary by December 1, 7987_ If Andersen <br />were to flail to do so, the suspended 55DDD would be payable by December 9, <br />1987. <br />On January 21, 1988 the Division received a request from Andersen Construction <br />to extend its deadline for corrective action.
