<br />-2- <br />I. Decision to Require Revision <br />Based on this mid-term review the Division finds that certain revisions and <br />modifications are needed to insure future compliance with the Colorado Surface <br />Coal Mining Reclamation Act and the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining. The following section details the <br />revisions required, justification for requiring the revisions and timetable <br />for submitting he revisions. Section IA responses should be submitted as <br />one package by January 1, 1985, while Section II (Bonding) responses are to be <br />submitted by November 1, 1984. <br />After obtaining the CMLRD permit (number.C-026-81) on December 1, 1981, <br />Wyoming Fuel Company continued operations in their existing Pit No. 1 until <br />July 15, 1982 when the Canadian Strip Mine went into temporary cessation of <br />operations due to economic conditions. The permittee did not commence <br />operations in pit No. 2 prior to temporary cessation. Currently, the mine <br />remains in temporary cessation with 57 acres disturbed and unreclaimed, of <br />which approximately 49 acres are Pit No. 1 and the remainder facilities, <br />ponds, and roads. <br />The Division has noted during this review that eight (8) of the 27 original <br />stipulations to the permit have not been satisfactorily addressed or resolved <br />by Wyoming Fuel. The Division has taken enforcement action in the form of <br />Notice of Violation Number C-84-159 to rectify this situation. <br />IA. Revisions Required <br />1. Le al Financial, Com liance Information - The Division finds that the <br />following in ormation is inaccurate an nee s to be updated to reflect changes <br />that have occurred over the past 2 1/2 years. Specifically: <br />a. Wyoming Fuel Company has acquired the former CF&I Allen and Maxwell <br />coal mines. Appropriate legal, financial, and compliance information <br />should be provided for incorporation into the Canadian Strip document. <br />b. Wyoming Fuel Company should update the compliance information for <br />the Canadian Strip Mine. <br />c. Wyoming Fuel needs to revise and update all copies of their permit <br />application on file with the Division to reflect all submittals received <br />by the Division after permit issuance; including but not limited to <br />revisions, responses to stipulations, and revisions required by this <br />2 1/2 year review. <br />
