<br />II. ISSUES RAISED BY OBJECTORS: <br />Issues raised by the objecting parties are listed below, alone with the names of the objectors. The <br />Division's response to objection issues follows. <br />1. The following objectors expressed concerns regarding possible impacts to surface and/ or <br />groundwater of the surrounding area. (Objector No.'s 2, 3, 5, 6) <br />Response :The mining and reclamation plan is designed to minimize impacts to surface and <br />groundwater in the affected land as well as the surrounding area. The operator will install a <br />slurry wall prior to excavation of the lame area to be reclaimed as a water storage reservoir. <br />The slurry wall will help to minimize evaporative loss of exposed groundwater and <br />corresponding fluctuations in the groundwater table of the surrounding area. The operator will <br />provide the Division with a written demonstration of compliance with all requirements of the <br />Office of the State Engineer prior to exposure of groundwater at the site. Possible impacts to <br />groundwater levels due to "mounding" or "shadowing" effects from the slurry wall aze expected <br />to be minimal and should not adversely affect anyone's water supply. Petroleum products to be <br />used or stored on site will be contained within a concrete containment system adequately sized to <br />hold any possible leak or spill. No other chemicals or reagents will be used during the mining <br />process which may adversely affect surface or groundwater quality. <br />2. The following objectors expressed concerns regarding CAMAS Colorado, Inc.'s legal right of <br />entry and statements pertaining to land use and easements. (Objector No.'s 3, 6). <br />Response :The mining plan has been designed to address concems of land use, easements, and <br />right of entry in all portions of the affected land, and particularly in the Phase lA and Phase 1B <br />areas where these concerns are greatest. The mine plan specifies a 10-year life of operation for <br />affected lands west of the South Platte River. Mining and excavation activities for affected lands <br />east of the South Platte River, such as Phases IA and 1B will be completed within a 24 month <br />period. <br />3. Objector No. 5 expressed concern regarding on-site and off-site disturbances resulting from <br />the proposed operation. <br />Response :The mining and reclamation plans have been designed to minimize on-site <br />disturbances. There are no known off-site disturbances, ie: outside the affected land boundary. <br />4. Objector No. 5 expressed concern regarding [he affect of the proposed operation on critical <br />habitat for endangered species. <br />Response :There are no known threatened or endangered species or critical habitat areas on site. <br />This has been confirmed by Mr. Dave Weber, habitat biologist with the Colorado Division of <br />
