In general there have been few changes from the <br />original permitting. There was a proposed and approved expansion <br />in 1992 that apparently never materialized to its fullest extent. <br />This revision did contain new baseline information for the soils <br />and vegetation that was reviewed and approved in 1992. It is my <br />understanding that the mine is no longer producing coal and is in <br />fact reclaimed. Given this current status I will contain my <br />remarks to anticipated activities such as reclamation and bond <br />release. <br />Soils 2.04 <br />A cursory review of the baseline soils data was conducted and no <br />problems were noted. With respect to soils the following questions <br />were raised. <br />1. Did the operator conduct the required sampling of the topsoil <br />after replacement and prior to reseeding? <br />2. After the topsoil was reapplied did the operator or the Division <br />verify the depth to confirm compliance with the approved plan? <br />Vegetation <br />The vegetation baseline data was also reviewed briefly and no <br />problems were noted. In reviewing the sampling methodology and <br />success standards no problems were noted, however, the operator may <br />want to provide additional information on exactly what the SAMPLING <br />DESIGN will be for both phase II and III bond releases. Reading <br />what is currently in the permit application it is not clear exactly <br />what that is and how it will be done. It is my recommendation that <br />this area (bond release sampling) be clarified to avoid problems <br />before these release times occur. <br />If you have any questions, please see me. <br />AJW/ajw <br />
