Proposed Decision <br />The Colorado Mined Land Reclamation Division proposes to approve, with <br />stipulations, a renewal of the Twin Pines No. 2 Mine permit to conduct coal <br />mining by Twin Pines Investment Limited Partnership. <br />The proposed renewal applies to the permit area indicated on Drawing TP-1 in <br />the permit application. This area includes portions of Sections 1 and 2, <br />Township 20 South, Range 70 West of the 6th P.M., in Fremont County. <br />This proposed decision is based on a finding that the operations as described <br />in the permit application, subsequent revisions, and the permit renewal <br />application will comply with all requirements of the Colorado Surface Coal <br />Mining Reclamation Act, C.R.S., 1973, 34-33-101, et seq., and the Regulations <br />promulgated pursuant to the Act. <br />The permit renewal application and the stipulations will became a binding part <br />of the permit upon approval. <br />The stipulations for the Twin Pines No. 2 Mine are: <br />Stipulation No. 3 <br />PRIOR TO THE USE OF MINE WATER FOR ANY MINING ACTIVITIES, TWIN PINES <br />INVESTMENT, LTD., MUST OBTAIN ALL WELL PERMITS REQUIRED BY APPLICABLE <br />STATE LAW. <br />Stipulation No. 10 <br />WITHIN 30 DAYS OF ISSUANCE OF THE RENEWED PERMIT, THE OPERATOR MUST APPLY <br />FOR AN AMENDMENT TO THE MINE'S NPDES PERMIT, ADDING THE NORTH SPOIL AREA <br />SUBDRAIN AS A DISCHARGE POINT OR THE OPERATOR WILL SUBMIT A TECHNICAL <br />REVISION PROPOSING A MEANS OF ROUTING POTENTIAL DISCHARGES THROUGH A <br />SEDIMENT POND, WITH AN APPROVED AND MONITORED DISCHARGE POINT. <br />Stipulation No. 11 <br />WITHIN 60 DAYS OF ISSUANCE OF THE RENEWED PERMIT, THE OPERATOR MUST <br />SUBMIT A TECHNICAL REVISION WITH A DESIGN PLAN FOR MODIFICATION OF THE <br />SURFACE WATER CONTROL SYSTEM INCORPORATING THE TREATMENT AND/OR DISCHARGE <br />OF MINE WATER AS WELL AS SURFACE RUNOFF FROM 7HE UNDISTURBED SLOPES ABOVE <br />THE MINE WHICH PASSES THROUGH THE SYSTEM. <br />Stipulation No. 12 <br />WITHIN 30 DAYS OF ISSUANCE OF THE RENEWED PERMIT, THE OPERATOR MUST <br />SUBMIT INFORMATION INDICATING THAT SURFACE DRAINAGE FROM THE TOPSOIL <br />STOCKPILES NEXT TO 7HE MINE ACCESS ROAD IS SUBJECTED TO ALTERNATE <br />SEDIMENT CONTROL MEASURES OR PASS THE RUNOFF THROUGH A SEDIMENT POND. <br />\ -2 <br />
