XVI. Roads - Rules 2.05,3(3) and 4.03 <br />The access road to the mine was removed from the permit area and is now being <br />maintained by Fremont County, as approved in TR-02 on August 28, 1987. <br />There are no other changes to this section. <br />The operation is in compliance with the requirements of this section. <br />XVII. Ponds, Impoundments, Diversions - Rules 2.05.3 and 4.05 <br />The planned Upper Bench Sediment Pond was never constructed. Plans for this <br />pond were removed from the permit application. <br />A sediment trap was installed at the inlet to the Lewis Gulch fill culvert in <br />response to Stipulation No. 7 of the original permit approval. <br />The operation is in compliance with the requirements of this section. <br />XVIII. Back filling and Grading - Rules 2.05.3(6)(b), 2.05.4 (2 )(a ). <br />Back filling of the north spoil area is underway, as discussed in Section XV of <br />this document. Backfilling of existing spoil material in the portal areas for <br />construction of the ramp to the north spoil area was done as originally <br />permitted. <br />Stipulation No. 8 to approval of the original permit required the operator to <br />demonstrate that there was ample material available to cover the waste <br />disposal area with two feet of non-toxic, noncombustible plant growth medium. <br />On November 6, 1984 a letter was submitted indicating that an excess of <br />195 yd3 of cover material was available in the berm of the waste area. <br />The operation is in compliance with the requirements of this section. <br />XIX. Bondin -Rules 2.05.4(2)(b) and 3 <br />The operation currently has bonding of $54,130.00 posted. After a review of <br />estimated reclamation costs, the Division finds that the operation is <br />adequately bonded. Therefore, no change in bond is necessary at this time. <br />XX. Sea of Drilled Holes and Underground Openings - Rules 2.05.4(2)(8) <br />an <br />There are no changes in this section. <br />The operation is in compliance with the requirements of this section. <br />XXI. Subsidence - Rules 2.05.6(6) and 4.20 <br />There are no changes to this section. <br />The operation is in compliance with the requirements of this section. <br />-13- <br />
