X. Topsoil - Rules 2.04.9, 2.05.3(5), 2.05.4(2)(d) and 4.06 <br />The original Findings Document contains information regarding the availability <br />and characteristics of topsoil at the mine site. Stipulation No. 4 (placement <br />of topsoil) and 5 (soil testing) were resolved by letters submitted on <br />November 6, 1984 and January 28, 1985 respectively. <br />Topsoil from the refuse area access road and the Lewis Gulch fill area has <br />been placed on the embankment and disturbed slopes of the access road and in <br />two temporary topsoil stockpiles next to the mine access road. There is also <br />a temporary topsoil stockpile at the sales/office area. <br />The topsoil stockpiles next to the mine access road are outside the sediment <br />control system at the mine. In order for the Division to grant an exemption <br />form the requirement to pass surface drainage from these areas through a <br />sediment pond, the following stipulation is necessary: <br />Stipulation No. 12 <br />WITHIN 30 DAYS OF ISSUANCE OF THE RENEWED PERMIT, THE OPERATOR MUST <br />SUBMIT INFORMATION INDICATING THAT SURFACE DRAINAGE FROM THE <br />TOPSOIL STOCKPILES NEXT TO THE MINE ACCESS ROAD IS SUBJECTED TO <br />ALTERNATE SEDIMENT CONTROL MEASURES OR PASS THE RUNOFF THROUGH A <br />SEDIMENT POND. <br />The operation is in compliance with the requirements of this section. <br />XI. Vegetation - Rules 2.04.10, 2.05.4(2)(e) and 4.15 <br />In response to Stipulation No. 6 to approval of the original permit, page 88a <br />was revised in the permit renewal application. This clarified the commitment <br />to revegetation success standards on reclaimed areas. <br />There are no other changes to this section of the original Findings. <br />The proposed operation is in compliance with the requirements of this section. <br />XII. Fish and Wildlife - Rules 2.04.11, 2.05.6(2) and 4.18 <br />Information in this section of the original Findings Document is still <br />accurate. <br />The application is in compliance with the requirements of this section. <br />XIII. Prime Farmland - Rules 2.04.12, 2.06.6 and 4.25 <br />The information in this section of the original Findings Document is still <br />accurate. <br />The application is in compliance with the requirements of this section. <br />-11- <br />
