The DMG contends these highwalls present a fall hazard and a rockfall <br />hazard. PCC maintains these steep slopes are common features at coal mine Facilities <br />and surrounding areas. There are numerous steep slopes and vertical cliffs in the <br />surrounding area. <br />Mine Drainage <br />Underground mine drainage and disturbed area surface run-off flows into treatment ponds <br />at the South Portal. The DMG contends if the treatment ponds and systems are left <br />unmaintained they may breach resulting in untreated mine drainage reaching offsite areas. <br />Since PCC will continue to maintain the treatment ponds and systems, the DMG's failure <br />scenario is flawed and therefore invalid. <br />Summary <br />PCC continues to maintain its DMG permit in good standing and on the ground <br />compliance is maintained. PCC works with the local DMG inspector and performs <br />recommended maintenance. The sediment ponds, refuse piles and associated drainage <br />systems are inspected quarterly by a registered professional engineer. Drainage features <br />are maintained as necessary. The mine dewatering system is inspected weekly. PCC has <br />demonstrated its commitment to protect the environment in the past and will continue its <br />exemplar environmental stewardship in the future. <br />Sincerely, <br />J. E.
